Refused to cut a branch

Eir (old eircom) put the line to our house over the neighbours property.

They put that line through trees, on said property. Now they are refusing to run the Fibre cable through the same route as the site engineer is stating that he will not work on their line.

Why is it that the line was originally run through, by this company but now they will not upgrade the line.

I'm being told that I must dig up my neighbour's lawn and lay ducting to the pole on their land.

If the line was running over the trees at the roadside he said he would have cut the gap no bother but won't over the lawn. They neighbours are fine with it being done.
