If he goes slashing peoples faces and necks during that period, he'll be in prison again but for a longer time.

But surely it's not 'just' slashing faces and necks?

ie. lesser crimes should be able to put him back in the klink while on probation as well no?

This is exactly why I think we need a gauranteed minimum one month sentence per previous conviction at every conviction. If you get your second conviction you must spend at least one month in prison, when you get your 21st conviction you must spend at least 20 months in prison. You could never possibly get past 30 convictions then in a human lifetime.

He has 90 convictions so far and he is still young, so far his average sentence has been less than one month per conviction.

Concurrent sentences should be completely outlawed. If you stab one person you might as well stab 5, it's the same punishment at the moment.

I'm sorry but this reads more like attempted murder to me, jesus.

I imagine going out with the express intention to murder someone is attempted murder. Mens rea comes into account with serious crimes.

No. All that attempted murder is engaging in an attack that’s likely to kill, that a reasonable person would assume could kill. Intent to kill.

I don’t think this was attempted murder, though.

The scrote has 90 previous convictions, so why suspend any of the sentence? Also, concurrent sentences? Why even bother? It's essentially giving him 8 years that he'll never have to do!

It is also an interesting point that Judge McCabe appears to differentiate between the sexes in his sentencing.
The Judge sentenced McDonagh to eight years in prison for the serious assault on the man, and suspended the final 18 months.

He imposed a concurrent four-year sentence for the assault on the woman and a further concurrent four-year sentence for the possession of the knife.

Given that the Irish State's behaviour towards Women has now been proven, in so many ways to be seriously wanting,it should surely be required that Judge McCabe justify,or otherwise explain, the four year difference for the same attack.

A more realistic sentence would have been 8 years on both counts,to run Consecutively, with the 4 years for possession,to be suspended from the date of release.

This savage attack, definitely merited a 16 year tarriff, with the only suspension being made available on the lesser charge.

Sadly, far too many Judges are looking worriedly over their shoulders,at the Court of Appeal and Supreme Court, when deciding upon sentences, when they should be considering only ONE point-The severity of the Crime.

Men, it has been well said, think in herds; it will be seen that they go mad in herds, while they only recover their senses slowly, and one by one.

The mindset where knifing two innocent people in public was just a 'mistake' says it all really. Thankfully someone called them up on that...

Relation: Do you not know the meaning of a mistake? We've all made them some worse than others...

Reply: He couldn't learn from his 90 previous mistakes no?

My understanding is that he is sentenced for 8 years with 18 months suspended, so he'll be out in 6.5 years time but on probation to serve the suspended part. If he goes slashing peoples faces and necks during that period, he'll be in prison again but for a longer time.

You forgot to account for remission so he'll probably be out in 5.

Absolute scum both this man and those who are defending him why we don't impose life sentences in this country i will never know because this guy sure as hell deserves it.

    Less Again!

I think every year is actually only 9 months as they get three months off for good behaviour.
Maybe that's with "life" sentencing though

Remission is 25%. 25% of 6.5 is 1.6 years off his sentence. That's only a minimum though so realistically he'll probably be out in even less.

The intent is to kill or seriously harm, given the sentences this amounted to serious harm. That said S4. Causing Serious Harm carries up to a life sentence anyway.

Why is not paying a TV licence taken more seriously than someone slashing someone else's throat in this country is there any proper justice at all.

If the facebook comments are to be believed, life threatening injuries vs non life threating injuries. More hospital time and more intensive medical intervention required for the male victim.

Also according to Facebook, suggesting that it might not be sexism is itself sexism. And also explaining how sentences are partially based on injuries to someone who says "I don't understand the justice system but this is clearly sexism" is mansplaining and sexism.

CCTV in the area captured the assault. The footage was shown to McDonagh but he denied at all times that he had been carrying a knife.

Garda Foley said he went to McDonagh’s sister’s house, where McDonagh had been staying at the time, and noticed that a pizza knife was missing from a block of knives in her kitchen. It matched a description of the knife used in the assaults.

    I am so smart, smrt

Frank McDonagh from Rahoon, Galway was jailed for 8 years with 18 months suspended after he slashed two people in the head with a pizza knife during an attempted robbery. He had 90 previous convictions and yet his family defend him on Facebook and insist he just made a mistake.

Fair play to the fella who intervened. Could've been a lot worse if he hadn't.

Let me get this straight, he attacked people with a deadly weapon, he had to be forcibly stopped, he was on bail, he denied it and he has 90(!) convictions.

Why wasnt he tried for attempted murder?

I think it will only be until his culture or other upstanding members of society commit genocide..until the sentence matches the crime. Concurrent / suspended sentences equate to no sentence imo

Years ago an American judge said you need a licence to drive a car, own a tv set or own a dog, but any assole can have a child.
