    "Suspended Sentence" Nolan presiding.

Judge martin f*cking nolan as I suspected. He should be forced to resign as he seems to think being a pedo is ok...

    Absolute disgrace.

"Mr Rahn said his client, who is originally from a large family in Waterford, went to university and had a good career. He said Phelan does not appear to have had any romantic or sexual relationships throughout his life."

Somewhat mean of Judge Nolan to deprive him of the opportunity to have his first ever romantic relationship - with his cell mate.

Judicial system in Ireland is in need of dire reform. The judges are an embarrassment. Our criminal justice system isn't fit for purpose.

Odd that the clickbait below the article (for me anyway) was this.

Are there ever any consequences for judges when sentences like these are being handed out?
Or would this be within the sentencing guidelines (if any)?

And if so, are these ever updated/reviewed? How often would this be done?

60.000 images isn't exactly something you just stumbled across like

Mandatory minimum sentences for certain offences would be a good start.
And we need a big new shiny and uncomfortable prison.

If the DPP is unhappy with the sentence awarded can't he appeal it?

  • Registered Users, Registered Users 2 Posts: 10,684 ✭✭✭✭Samuel T. Cogley

I can't tell whether you agree with the sentence or not.

Well I wasn't quite sure if the final etc. should have an additional full stop or not.

Most of the DVDs were naturist in nature? Didn't realize naturist videos were illegal......

Anyone remember that H&E magazine that they used to have in shops. I remember as a kid looking up at that and wondering how shops could have a magazine with naked people on it but yet Playboy was banned here at the time. Not that there was much to see in it. Remember one of the lads nicked a copy once and it was just full of old people playing tennis.

Anyway, I expect that was a large part of the reasoning behind only handing down a suspended sentence plus also of course the fact that he had no previous.

Most worrying thing is this creep was involved in the Department of Health and Children. Doesn't bare thinking about.

Doesn't happen here sorry to tell you. He'd have been segregated for his own protection because the rest of the inmates won't stand for anything to do with children being abused. Anything sexual with kids and/or being an informant are two universally lauded things inside.

Not sure but that was the least of our thoughts as there were plenty of photos of families cooking at camp fires naked and we were all wondering how their, eh.... kindling didn't catch fire :p

Phelan does not appear to have had any sexual relationships throughout his life

Poor thing never got the ride. We’ll let him away with his little private perverted hobby so.

While out judges appear untouchable unless they commit murder in front of a 100 witnesses, nothing will change.

Sure wasn't that Judge from the tralee district who got caught with Image's, notorious for letting certain individuals off with criminal activity.....

Won't mention any names....but its out there....

When I saw he referred to 60,000 images as "a fair bit" I actually laughed out loud, that's one of the most ridiculous ways possible of putting it.

What an utterly appalling piece of work.

If someone is in possession of child porn images then they should be charged with child abuse or of being an accessory to child abuse.

There needs to be a serious change of attitude towards serious crime and repeat offenders in this country.

Jail is only for a certain class of people.

Can’t pay your tv licence, lock’em up.

Nice middle class background, “Get Out Of Jail Free” cards galore.

6 images should be enough to make people fear jail... but

    60,000??????

I can't believe there are much more than that in the whole world. No matter what the outcome was, a message was going to be sent... but this is the message?

That guy is a marked man for the rest of his life, thats probably sentence enough.

The judge probably felt that he would not have been safe in prison, plus he has been attending rehab since 2013.

Im not trying to defend him or his actions, its just that there are a lot of people walking the streets at the minute who are guilty of a lot more serious crimes simply because the Irish prison system does not have the space or resources to cope with them.

For example, a recent enough case where a man got 5 years with the final 2 years suspended for attempted murder with a butchers knife. Victim was in intensive care for a week.

"Naturist in nature" me hole. If you are a pedophile and you have a questionable image of a child, then by it's nature it's pedophilic.

He'd have been sent to Arbour Hill, along with all the other perverts and rapists. Sure they even have their own prison in this country. ;)

It's interesting the way "mitigating circumstances" include that the person has destroyed his reputation etc. Yes, I understand that. And it is a real life sentence destruction far greater than a mere prison sentence, as the Tom Humphries case shows. But it's loaded with socio-economic prejudice.

How often, for instance, do you hear that particular "reputational loss" mitigating circumstance about an equally obnoxious gurrier, but one who did not have a good job or a university education but instead who lives in gurrierville and left his gurrierville education very young?

They tend to have "troubled upbringings", "come from broken homes", and some drink/substance abuse.

Only ****ers without a get out of jail free card are those who **** with the revenue.

Jail is too good for pedophiles IMO.

Why should a pedophile have a nice cushy number on the inside?

Let's face it, it's not like you can cure these kind of abnormalities of the human race.

A good long sentence of hard labour, with no parole would be preferable.

And that would still be too good.

Just on this as I always see it trotted out. TV license offenders don't even see a landing. It's sign in, doctor sees you, picture taken and on you go.

So being a paedophile is more acceptable in this country than someone who doesn't pay their TV licence is this some kind of sick joke.

    What's with the dr Omackeral?

As in : why would they need to see a dr if they're just going to be shown the door then?

You would think that those who harm children would cause the most outrage to our justice system bizarrely that doesn't seem to be the case.

It's among the first ports of call for any committal, regardless of how long they're gonna be staying there. It's the same for anyone returning from court or hospital or a compassionate funeral escort. When they are shown the door, they're officially let out under temporary release terms (TR) but in reality it's just bye bye.

Putting these sickos in jail for a few years and then letting them loose again in a different area is not the answer. Something drastic has to be done to deter this as there is no cure for these freaks. Its getting all to common and time now to severely up the penaltys.

  • Registered Users, Registered Users 2 Posts: 7,259 ✭✭✭donkeykong5

Signed a petition about this judge 2 years ago. His sympathy for filthy paedophiles and child porn down loaders is questionable.
