Rent - Case 1 or Case 5?

    Hey guys,

    So normally a company in receipt of rental income, it is taxed as Case5. What are the circumstances where it is taxed as Case1?

    It is very rare that rent of real property will be assessable under Sch D Case I. Where property is held for the purposes of development by a dealer it is possible that short term letting a might be so assessed. Otherwise, only where the level of integral services is such as to mean that it is more than a mere rental (such as with hotels, B&Bs etc). There’s an interesting case from more than a century ago involving the Rotunda Hospital and its entertainment venue.
