    I think it is state dependent, two months in Saxony, but as you say three months elsewhere e.g. Hesse. So the idea amongst the Irish Gov that two months is exploitative is odd. The idea that tenants are vastly more secure in Continental Europe really should be questioned.

    What is to stop a landlord charging by the quarter. A quarter's rent plus a months deposit up front?

    Do not provide ideas to the govvie! If they want to go full socialist they could just say you cannot ask more than one month deposit and one month rent in advance. Even worse no rent in advance to make it even worse only monthly in arrears (so that any minimal deposit protection is gone: after all the wonderful HAP scheme works like that) in addition no third party guarantors can be asked for. I believe this will really nail it.

    Well then they could go the communist /anarchist way: rent is theft from the dirty capitalists, let's introduce a 12 -24 months moratorium from rent (believe me some Latin countries have done it in the 70s) and finally perform an expropriation of all non ppr residential properties for the sake of the common good ( Venezuela style), after all the constitution allows limitations of property rights for the "common good" which is a term that unfortunately lacks a clear definition!
