    Where did custom get the power to set up a checkpoints by themselves pass one yesterday with no garda present

    They have it for as long as I can remember. They also have the power to break in to a vehicle in order to test the fuel.

    They don't even need to set up a checkpoint as they can stop you anywhere at random .

    Just always thought garda people in charge of animals plus a few more where the only ones that can stop you on road. Plus the customs car there only has a few red flashing lights on them

    No nearly about it. One of them crashed into me before. When the Gardai arrived, they refused to identify themselves to them, and there was nothing the Guards could do about it.

    I'd say that a Car Reg check told the Boys all they needed to know

    No nearly about it. One of them crashed into me before. When the Gardai arrived, they refused to identify themselves to them, and there was nothing the Guards could do about it.

    What would happen if they seriously injured someone or mowed over some pedestrians? I doubt they could just drive away into the sunset with no consequences.

    They just didn't personally identity themselves, the guards collected enough info about which branch they were attached to etc and I was able to get my car fixed.

    Just asking because the Customs Officer will be in court along with a state solicitor. Get your story straight.

    Probably cheaper in the long run.;)
    And I find it hard to believe they took €2,000 off you on the day. Most people get charged with the MGO offence and then get fined at a District Court.
    ...unless it's an NI reg Navara ???

    edit; they will normally only try and negotiate an "on the spot" fine if the vehicle isn't worth seizing.

    What custom man said if you pay at the road side you will avoid court prosecution and it €1000 private car €2000 for jeep

    Im not arguing with you or disputing your story but I have been in court enough times to hear Customs officers give their evidence and answer questions either by a judge or defence solicitior.

    I have yet to come across a case where the judge has ruled against Revenue in cases of MGO. I'm not saying it has not happened but in 17 years of attending rural court houses I have not witnessed it.

    One final bit of advice, if you're not paying the fine at least show up if / when summoned.

    Not a hope in holy hell they'll believe that. IF this was the truth, once your 'friend' informed you he'd used the green diesel, you knew you couldn't have the car on the road, and should have arranged to get it taken to a garage to be siphoned. So it's all on you and the fine will stand.

    How will you get name on paper work???

    You paid to release the vehicle.

    Hopefully you get caught again if that's how you go about it.

    If you can't afford to run a 2013 get a Micra or yaris or use the bus.

    You could also visit the customs guy and offer him money to redo the paperwork in another name, I've heard the respond to that sort of thing...............
    Whether they respond positively or negatively for your point of view is your risk to take.

    But he did say how did MGO get into tank I told him the story about polish friend and the eco diesel etc custom man just started laughing at me like he didn't believe me .and then he say if you have means pay at road side it €2000 or you can go to court with your story and see what the judge think so I said I pay now but he should have ask for his name which he didn't
