REST: How to put payload tags into REST call

The following code will not validate as a REST call

<payload>
{"patients": [{"sponsor": "test1","protocol": "study_5449","site_number": "1-Add-Patient-5449","subject_number": "RT0008","subject_status": "T","randomization_date": "01Jan2017","treatment_id": "pathway_5449"}]}
</payload>

However, if i remove the Payload tags this will work fine. I want to include them though - how would i achieve this?

The payload tags look like XML, otherwise the content looks like JSON.

You could put the JSON object in a parent payload JSON object?

Your question doesn't make a lot of sense. What do you mean by it validating as a REST call? That's entirely dependent on the receiving server. If the server expects a <payload> tag with JSON inside, the call will work. If it doesn't, it won't
