I recently sold my car privately. Nothing mechanically wrong but it was missing hubcaps at the time of sale because i took them off for NCT and at that time we were doing home renovations and subsequently I cant find them. He bought the car on my word that I would send them on but after searching everywhere I genuinely cant find them and didnt know they were gone at time time. I have offered to give €50 back for him to get new second hand ones himself and gave him the link to a website but cant find the size and wants me to go to a main dealer to buy them which will cost well over 100 anyway. More. Will I have to do this or what should I do?

Get some used ones from a scrapyard. Your ones would have been used either way. My view is that is you made a promise you should honour it.

Tell him you found them. Which should negate any arguments he'd have that they're not exactly the right design.

I am meeting him half way by giving him some money back to get whichever ones he prefers himself. Is this not sufficient?

You're being a very nice guy to offer 50 euro back to him, surely can pick up aftermarket Halfords style jobbies for 35 euro anyway

  • Registered Users, Registered Users 2 Posts: 73,523 ✭✭✭✭colm_mcm

Halfords/Lidl/whatever aren't the same quality or fit or look as manufacturers original trims.

You owe the buyer the wheel trims rather than money.

You'd nearly pick up a set of alloys for 50€

Why should he meet you half way? You foolishly made it a term of the contract. You need to perform your side of it, either source him ones of a standard which yours would have been or pay him what it would cost him to get them plus adequate compensation for his time. Soon enough, you'll be happy to pay him €100.

    thats what i was thinking

x2, A3 wheetrims are distinctive though and I would notice that Halford/Lidl ones were on a car for sale rather than the original. Still think an offer of 50euro back more than makes up for it.

    their hubcaps not the engine

They have little to be at looking for hub caps, and there is no contract.
I wouldn't bother answering them anymore.
Private sale, they took the car as is, end of.

Offer fifty quid and if he doesn't want it tell him to go jump.

You made the offer on good faith and you genuinely can't find them.

**** happens, expecting you to stump up for some overpriced plastic is taking the piss.

On another note, how is that 2nd hand Audi you recently purchased going for you?

not your problem. The car works, hubcaps don't make a difference.

He should be lucky to get any offer from you.

    The neck on some people.

Some of the replies on this thread clearly show why you should never pay in full until the deal is complete. No bits missing, no paperwork missing etc.

You obviously won't get much sympathy on here if the seller breaks his word later.

  • Registered Users, Registered Users 2 Posts: 1,646 ✭✭✭Mehaffey1

Even cheaper then, 28 euro for your conscience and "reputation" as a seller is more than enough to part with.

Should be able to pick up a set handy enough in a breakers or ebay.

If they were off for the nct they were probably this sort of thing. Prob not exactly the same but the star type that covers the wheel nuts

If I was in the buyer's shoes then Caveat Emptor would be the quote to the foremost of my brain and in the world of 2nd hand car deals to not trust a word the other party says as rule either buying or selling.

OP loads of centre caps on the ebay for less than you're offering.

Blocking his number would not solve it. He would still be short the hubcaps.
You said in the op that the deal was for the car plus the hubcaps.

A deal's a deal. Not very wise to promise the hubcaps but you did so you should keep your word. Seems to be lost on a lot of people on here though.

To the buyer, it just takes away from his new* car and obviously just wants what was promised. Nothing unreasonable about having that expectation satisfied. I would expect them to be sent on if I was promised them, but would also accept the money offer if I knew I could get genuine replacements for that money.

The dismissive comments on here are just pathetic. Small problem until it's you getting shafted in a deal.

*obviously it's not a new car

Agreed, a man's word is his bond and a real man would stick by his.
Perhaps the op is a woman in which case she's exonerated

If you make a deal you keep the deal. If for unforeseen reasons you can't, then you compensate the other party.

From a legal pint of view though, the op can tell the buyer to sling his hook.

  • Registered Users, Registered Users 2 Posts: 7,302 ✭✭✭Supergurrier

    Shafted on centre caps lol.

I wouldn't even use my own sim card selling a car and i never have.

    Buy disposable sim
    Sell car
    Hop sim in bin

    Deal done

  • Registered Users, Registered Users 2 Posts: 10,633 ✭✭✭✭Marcusm

    Compensation for his time? Seriously?

I meant if he expects him to go off and buy them himself; I'm simply making the point that the OP made a silly mistake but should live up to it. If the cost of that is €100 then so be it.

  • Registered Users, Registered Users 2 Posts: 10,633 ✭✭✭✭Marcusm

And what am I trying to do? I could have easily blocked his number and solved it but I am giving him money back over a genuine error

You're coming off lovely; I promised something reasonable to the fella who agreed to buy my car. I can't live up to my end of the bargain but am I not a great lad, I offered him not quite the cost of a replacement but more importantly I haven't blocked his calls. Seriously. Just give him the €100 and not promise what you can't deliver in future.

  • Registered Users, Registered Users 2 Posts: 8,035 ✭✭✭goz83

A small shafting is still a shafting.

I've always sold my cars with my real number and with nothing to hide. I wouldn't buy from someone who wants to do the deal in carpark, which I consider to be the throwaway sim sort. My brother got stung a couple of years ago when he bought from a carpark and the car turned out to be a complete lemon.

  • Registered Users, Registered Users 2 Posts: 14,721 ✭✭✭✭CianRyan

**** that, it's an honest mistake and if they're now being a little bitch about it then let them be a little butch far away from you.

You looked for them, you kept your word. They're gone, that's too bad for the buyer but hell, he'll live.

You were overly generous offering him €50, if he doesn't want it then don't give him anything.
It's a private sale, you're not a dealer. You don't have or need a reputation.

He bought the car on my word that I would send them on
So he is threatening legal action for compo on the basis that you said you'd send them on i.e. no written agreement?
You've made hom an offer. He rejected it. Time to block his number now.

  • Closed Accounts Posts: 16,705 ✭✭✭✭Tigger

Is a persons word not their bond anymore?
If I make a deal I stand by it, if I make a mistake and I lose €50 I make a mistake not the person I made the deal with. I honestly didn't think people would think that the op should walk away from a deal he made.
Legal he can do what he wants but it's a cheap move .
