Cancel your Meteor or Eir contract without penalty

    Not sure this is a Bargain Alert as sucjh, but it will help people save money and it will get more exposure here than on other forums

    As per the notification "Billpay online 14 day cooling off period 14 June 2014 – 30 June 2015" located here

    Basically if you signed up for a Bill Pay contract with Meteor between 14/06/2014 and 30/06/2015 you can cancel your contract without penalty as Meteor did not correctly inform you of your legal rights.

    You have until the 17th of this month to do so. Afaik they are entitled to the handset back if you got one, however you should also be entitled to a refund of the money paid for the handset.

    How does this work? Are they automatically entitled to the handset back? I signed up in September 2014 so Ive paid roughly 60 pm (50 was bill tariff + 10 on extras). Are they entitled to handset back then? What if it is damaged? Mine died like 3 days ago haha. Software issue I reckon but HTC wont repair it unless their is no visible damage on the outside.

    Doubt you have to return the handset, as they will have to refund you for it.

    According to the terms for the cooling off period, that they are now allowing customers to cancel under (Here)

    "9 Responsibility for any diminished value of good and services. If you use our products and services before the expiry of the cooling off period you will be liable for any diminished value of the goods or services. You will also be liable for paying any service charges incurred such as line rental, call charges or data used up to the date of cancellation."

    and

    12. Refund Policy We will refund the original purchase price (less any discounts less any diminished value/ services charges for the products or services you’re cancelling, together with the delivery charge, as soon as reasonably practical and in all cases in accordance with our statutory obligations.

    So you must return the phone to them and they must refund you, however they can keep some money for diminished value, due to the passage of time the goods in many cases are significantly worn, so i'm not sure where the balance between their breach of your rights and a fair and reasonable amount for the diminished value is.

    Yes this also applies to embile/eir customers. Their notification can be found here.

    Just remember, this is only applicable to people who purchased online or over the phone. Doesn't extend to bricks and mortar purchases.

    Did you read the OP? It's only for purchases back in June, not October...

    Yea got my phone back at start of year over phone... So should be entitled to this tried rining there but they aint open till morning... They require your handset back mine got smashed up after 5 weeks into contract so wonder where that will leave me... Worth a shot though...

    Im within the timeframe but don't know what to do. Don't have the money for a new iPhone 6s plus at the moment. Think i'll let this one slide

    Then cancel your contract and move to a sim only plan and you'll save heaps? If they come after you phone they'll have to pay your for it, and then you have the cash. It is a win win.

    There is absolutely no way this cannot work in your favour.

    (Well if you were on an outstandingly good contract that no longer exists it might, but I doubt that)

    But they can only give me back what I paid for the phone which was what 150 at the time I think for the 2 year contract. Are you suggesting you get back retail price of the phone off contract?

    If I kept the phone clean and clear it wouldn't even warrant thought I would do it.

    I got an iPhone 6 from eMobile last April.

    I was originally put on a 3G plan but requested to be put on a 4g plan in May so I basically entered into a new contract then, wonder if I can still cancel. I ordered the phone over the phone but collected in store.

    Getting out of the contract would be fine, but giving back the phone and going looking for a new carrier would be inconvenient.

    I'll see.

    I just called Meteor about this. They are sending me a jiffy bag so I can return my phone and once the phone is considered in good working order then they will refund me the price of the phone.

    That is odd as Meteor never said that to me. Even if you've signed up for an account do they expect you not to use the phone in the 14 day cooling off period ... something stinks with that explanation.

    Maybe the person I was onto wasn't really up to date on the whole thing. I'll call again and see if someone different has a different explanation

    That's completely untrue. If you do want to get out of your contract, contact them again and speak to a manager if necessary.

    Ok, just deleted my original post. I called again and spoke to another lady. She said I am entitled to cancel and is passing my details on to the retention team who will call me back today. She kind of implied that the retention team aren't entirely sure of what they are and are not supposed to do in this situation so maybe that's why the previous agent gave me a different response.

    Thanks for the heads up on this OP. Was looking forward to changing to a cheaper plan in the summer but this could be great

    It applies to online and phone orders only.

    The reason for this is because online and phone customers weren't informed that they had a 14 day cooling off period.

    This doesn't apply to in-store purchases because there is no legal right to a 14 day cooling off period when bought in a shop.

    The first guy I spoke to in Meteor said the same thing regarding not using the phone but when I rang the 1800 number I got through to a loyalty team who knew exactly what I was talking about.

    Wasn't worth it for me as I only paid 149 for my phone so that's all I'd get back and move to a plan for 25 per month instead of 32 so I'd need to buy a new phone and only save 7 per month for the next 8 months.

    If only they'd let me keep the phone then it would be perfect :D

    Just rang eir(emobile) to find out if I could cancel as I signed up in October last year, they put me through to the loyalty department. The girl I was talking to at first didnt have a clue what I was talking about, and then claimed it was only valid for Meteor customers, I asked why was it on the eir website if its only valid for Meteor customers, after some back and forth, and the realisation I was getting nowhere I just gave up.
    You'd think they would at least inform their staff of changes to contracts etc.....

    I was asked what condition my phone was in. I told her it was almost 18 months old so it's a bit banged up. She told me to send it back and they would see if it was worth a refund or not. Considering leaving this one alone at this point. Saying that I do have an iPhone 6 from work that I could transfer my number to and save myself €40 a month.

    I signed up over phone and I was looking at my receipt last nite and it stated I had 7 days to return...? Ain't it meant to.be 14 days... Also I took out 18 month contract and I asked how long was left they said it was a 24 month contract... Really don't like this company after being loyal to them for over ten years...

    Was just on to them earlier. Got my phone Xmas 14 but dropped it and broke screen. Repair company savaged the repair and gave me a replacement. Cos imei numbers don't match up i can't return under 14 day rule. Might email complaints dept and see how i get on.

    Notice for Meteor Bill Pay Customers who have purchased goods online from Meteor during the period 01/06/2014 to 01/06/2015, as of today 3rd November 2015.

    Why does this apply to phone orders?

    Was on the phone with them earlier, an agent asked why would I cancel the contract and I explained that the price plan I am on is simply not worth paying for (1GB internet usage, limited free calls etc). Then he offered 3GB extra internet add on for 5e if I stay with them till the end of the contract. Might as well just stay with them coz I cant be bothered to get a new phone and reinstall all the apps etc

    Ask them to put you on a cheaper tarrif due to financial difficulties .

    your right davywalsh7 the finding refers to a 'distant contract' . . . .blah . . . blah . . .without the physical presence of the trader and consumer . . . .

    so open to interpretation.....

    I called them and they told me NO, but I could avail of an early upgrade (3months off the contract end date)
