    My neighbour has built a monstrosity of a swing set for his kids. Also when they stand on the top they can see over the fence with ease. :mad:

    That's a bought, factory made swing. Its hardly a monstrosity.
    I had visions of them having built a 3 Storey structure in the garden.
    Now unless the actual parents are up on top of it looking across, you have little to complain about.

    Absolutely nothing illegal about it, you'd get laughed out of the place.

    Going to assume you don't have kids yourself, and you don't seem to get on that well with the neighbours, judging by your reaction. So, ok, it's a definite problem to you. Your options really are to make the fence higher or plant some sort of fast-growing hedge against it, although the garden doesn't really look big enough to allow for that.

    By the way, the law in question would be "nuisance", a part of tort law. I'm better at it in an American context, but Irish law isn't so different, so here goes: If OP could prove that the neighbour's use of their land was a nuisance to him, i.e. preventing him/her from the reasonable enjoyment of his own property, s/he might have a case against them to desist whatever it is that they're doing. Now in this case, while it is seemingly a nuisance to him, the neighbours aren't doing anything unusual - a swing is a perfectly reasonable thing to have in one's back garden. Following Slaird v Klewers (1970), while an American case, this too would almost certainly be tossed out as the plaintiff/OP being "over-sensitive", and it being more his own perception of a nuisance than a reasonable claim in a court.

    Do children normally stand at the top of swings?

    If you start looking over the fence and take pictures of the children playing, the parents will keep them inside.

    I'll give the OP the benefit of the doubt, you never know his neighbours might be an absolute nightmare and the swing set so close to their fence might just be an annoyance in a long line of sh*te. Tbh, we had neighbours once who put a swing set only a few feet from our living room window and it was a pain in the ass. I know kids are kids and they play, but listening to someone else's kids for hours on end isn't any fun, especially if you can't get away from them.:)
