Sounds like clutch isn't disengaging fully.

as ive the clutch pressed & go to select a gear it makes a small whining sound,
then when in gear the whine is still there...

take foot off the clutch & it goes away

I'd say the release bearing guide is worn.
Fierce common to go in them, I've sold two of those this week alone.
The part is cheap: it is around 13 Euro, but the gearbox has to come off...

The linkage joints do give trouble as well, but then you wouldn't have the noise.

would the guide come in a new clutch kit (as i might aswell replace the clutch while box is off)

No it wouldn't, only the release bearing would come with the clutch kit.
