Planning permission - site outline

    My uncle has obtained planning permission for a house and commenced works.
    The site is in a field, one back from the public road. The site access runs through an existing gravel drive in the front field to the site in question.
    The architect has enclosed the entire site including the access drive all the way to the public road within the boundary of the site (outlined red).
    A right of way is in place but will this be sufficient. Would the entire site as enclosed in planning site need to be in full ownership of my uncle. His solicitor is coming back to him on it but the Architect who has come on board for construction stage is not too sure if it will be sufficient. He says he will be required to complete a standard document stating, that the works are contained within the site as per planning and that the planning site is entirely located within lands owned. He said that seeing as no development is required within the front field that he would have left that area out of the site layout if he had done the planning application and resulted in a cleaner solution. We dont know if he is just running down the last guy or whether this is a major issue.
    Any help?

    The architect is pretty must spot on in his quoting of the certificate.

    If your uncle is borrowing to build the house then the bank need to know they can sell it if they repossess it. In order to sell it they would have to sell the entire site enclosed in the planning permission. As per your current architect it is generally considered a good idea to enclose the smallest area possible in your "Planning Site" unless you have a reason not to.

    If you have time and the inclination you could apply for a change of boundaries.
