If a person was to buy about 5 acres of land and heard from the previous owners that the SFP was being claimed by the neighboring farmer.
    1. How would you know other than asking the farmer? Is there a way of finding out on line? Or would you have to ask the Dept of Ag?
    2. How much is it worth to him for 5 acres annually? Its good grazing land.
    3. Is the claim legal if he has never owned or leased the land in the past?
    4. If the new owner wanted to fence this land for sheep would the farmer be entitled to a fencing grant?
    5. Could the new owner allow the farmer to continue to claim the CFP and allow some grazing stock on the land for part of the year in exchange for fencing the land?

Claim isn't legal if he's not using the land, it's being done because there's so few inspections that they're un likely to be caught.
You could set it to him for the price of the fencing and if the fencing grant is available(which we won't know till the end of the year) you probably will be able to get it yourself.....much more straight forward and legal

Is there anyway to see if he is actually claiming it? without dropping him in it...whats that saying about neighbors and fences:)

Sure ask him, tell him the previous owner told you he had it claimed on last year, if he's evasive tell him you're going to ask the department...give him the chance any way to come clean,
