directors and p35

    Hi,

    I wonder is somebody could help me. I have to submit a p35 using ROS and I am a bit confused. The company has 2 directors, no income and no salary paid by the company to any of them. Turns out company is registered for employer taxes so it is mandatory that we submit a P35. ROS offers the possibility of filing a nil return saying there were no employees for that year. Would that be our case? It seems straight forward.

    The other option I can think of would be filing a p35 including directors as employees of the company but since there were no payments, all amounts would be zero. This option seems a bit weird.

    If there was nothing paid out in salaries to them, then yes, I believe it would be a nil return.

    In some cases where I have done a P35, we have had to enter in the employees one by one (ones which do pay employer taxes) and we have to put the directors down. On the P35 filing page you enter in their PRSI class, so if they are a director, they will be S. So ROS will pick up they are a director, even though you've technically speaking, put them in as an employee. This is all nothing in your case of course, but thought I'd let you know for future reference.
