    I've a tenant who when I said I was giving him notice for not paying his rent he said to me
    "that he won't be paying what's owed OR the money due until the quitting day"
    Do I suck it up - looks like I have to.

    I would say it depends on what exactly is to be done. Major plumbing and roof work, as stated by the OP' might be counted as refurbishment.

    Just get it done.
    Get the person out and let them sue you for illegal eviction afterwards.
    My fav is put the elec/gas in your own name and get it turned off.
    They usually don't last too long after that.

    The right thing to do is give proper notice, they'll ignore it, and you'll chase them through the PRTB and the courts, only for them to leave you out of thousands of rent, and perhaps in thousands in repairs and legal fees. Which will be almost impossible to recover from the tenant. :(
