Paramedics get TOIL no overtime!!

    New paramedics in the HSE will only get time off in lieu for overtime hours and not pay.

    To add insult, management will determine when this TOIL can be taken.

    Any views on wether they can do that or not?

    Annual leave is always taken at the discretion of the employer so I assume TOIL would be no different.

    Overtime is not a statuatory entitlement.

    It's down to your employment contract. If your contract states you get overtime then you get it.

    However, I presume they will issue these new employees with contracts that state TOIL is the payment for overtime.

    Can they make you do compulsory overtime in return for TOIL?
    I presume if you sign up to the contract the answer is yes.

    These paramedics will receive overtime as normal when their shift overruns due to a late call. TOIL will only be for any extra shifts they agree to work, these shifts are not compulsory.

    Exactly.
    Their hours must average 39 hours over a given period of time, just like everybody else. But as they don't follow a roster they may run over at times. For example, the staff member requires 30 hours next week to average their 39 hour week, but they work three 12 hour shifts so they have 6 'green' hours.

    Not quite, they must work 156 hours over a 4 week period which equates to 13 shifts per 4 week period (which works out at 39 hours per week). Any full shifts above these are voluntary and will incur TOIL.

    Like I mentioned they have to average 39 hours over a specific timeframe. If they fill a full rostered week for a rostered member of staff (close to the end of their timeframe) and that week includes additional hours above their average 39 then they will have 'green' hours.
    Late calls will be paid as overtime.

    I know that's already how it works for some hospital dieticians. No paid overtime, if you have to work late you MAY get TOIL but it's capped at something like 4 hours a month, if you work more o/t than that it's tough

    If you get a late finish it is paid as overtime to the nearest minute.

    e.g. I am rostered to finish at 20:00, I have a call at 19:45 that finishes at 21:10 - Thats 1 hour 10 minutes overtime.

    Tullamore control pay for all new entrys since 2010. they work out what 10mins overtime is paid at.

    Once the paramedic does not owe the system green hours then they can work overtime shifts and get paid at the overtime rate once the shift is an authorised overtime shift - Someone has gone sick and there is no one else to cover that shift form other stations.

    A lot of bases are now rostering extra crews / extra personnal to cover sick leave / emergency leave. If someone goes sick then they just move about crews. No need to send out for someone to cover and no need for overtime.

    What region's/stations have extra rostered crews on to cover OT and emergency sick ect..?

    the west.
    There might be a third person on with an crew with and AP. If no one goes sick then the AP goes into the Respose car and can provide ALS where needed. If someone goes sick the the crew is covered.
