    It's a bloody mess alright.

    FWIW, if someone posts their own work up here and you quote it, that's pretty much fair game as the poster agrees to it as part of signing up to the site. They can, however remove their permission subsequently and then it gets really messy!

    The Regulations are so unclear, the fact of the matter is, it will probably take a court case to get some concrete definitions of what is or isn't allowed. We don't want Boards to be the first defendant!

    Is fine to go ahead as he already has done with our stuff. (have just been discussing the issue of this law at office here). No objections here.

    However, copyright credit must be correctly given. Even if lifted off another website, the IRFU logo is copywritten to the IRFU alone and not any other website taken from. Ditto with the likes of the IRB logo to IRB or RBS Six Nations to at a minimum, www.rbs6nations.com if not RBS Six Nations.

    If used in a money-making venture, then different story.

    Only copyright holder officially uploaded videos should be embedded. As a lot of highlights and snippets of games will fall foul of this law, they should not be embedded.

    Match Streams

    This has always been a grey area and unfortunately now it has gotten to the point where we will no longer allow the linking of streams.

    In match threads people can link to sites that have the official rights to broadcast the match on-line, however if there are any geo location restrictions there is to be no mention of ways to bypass this.

    I'm getting a very strong impression that you have not actually taken any legal advice before posting this crap.

    URL linking has never been found to be a violation of copyright in any EU state, and it's the sort of thing that's likely to be laughed out of court by any competent judge. Video snippets are covered by fair use.

    It is being used in a money making venture by Boards isnt it ? Boards is publishing it not the user.

    I think we are in new territory here regards the recent legislation. URL linking to sites probably will be found to be a breach of copyright under the new legislation and may result in ISP's blocking access to the sites who do it.

    Probably better to err on the side of caution until it all becomes clear.

    Sorry folks, I'm going to close this thread for the time being. We need to look at the full implications for Boards of Mr. Sherlock's trigger happiness and implement appropriate measures accordingly. However we don't have full details of what we need to do yet, so it's best not to further speculate on what will happen. Dav has posted an official statement here.
