Rights when ordering take-away food

    Not sure if this is the right section but it should stay here purely for the fact I'm sure it has happened to most.

    Tonight I ordered a chinese take away at 8.25pm. It was delivered around about 8.45. Pretty good timing in my eyes.

    I paid for my meal. €13.20 including delivery and a can of coke. Came in and immediately put my rice on the dish, then the meat and sauce on top. Went out to the kitchen, got a glass, open the can of coke n poured it in.

    Started to eat the food, around the edges as most would, only to find it quite cold. So went in for the middle bottom, and equally as cold.

    The driver had gone, maybe 4 minutes, maximum.

    I called the place straight away and the woman was having none of it. Without quoting her word for work she used excuses such as well its not like when you eat in our restaurant and the food comes out in a hot dish. She also blamed the weather, yes that is right. Its particularly cold tonight so with the dish being in a container it can cool quicker.

    To make matters worse I was on the phone arguing with her for a good 5 or more minutes that the food was then stone cold.

    For anyone wondering how long the drive from the kitchen to my house, I'd say 3, 4 minutes max. The place in question is in Killiney Shopping Centre and I live in Ballybrack Village.

    I'm not usually a moaner or complainer but this is just not acceptable. What are my rights? Should I not be entitled to a refund of some sort?

    Oh and one more thing, if your ordering from here don't order beef, as cold as the food was the beef was dire, i couldnt break it up with my teeth, like eating a rubber.

    Any chance of some actual help here :) Although I did like the China comment. As for Microwave I should not be expected to order food to eat and then have to reheat it 25 minutes after it was ordered

    13.20 if the food cost that much they have to get Securicor to deliver it so there is an extra delay.

    It depends. Did you specifically state that you wanted hot food?

    If not, there was no contractual agreement for them to deliver hot food.

    I'd normally heat the plates in the microwave for 2 mins before putting the food on them. as for rights.......you have the right to remain silent!:)

    Always check your food to see how hot it is and if they've delivered your full order when it arrives, saves hassle like this.

    If you cook your dinner at home and then leave it for 25 minutes I'd bet it's cold too...

    Please dont take this as being smart, I really dont mean it like that but am I meant to leave the driver standing at the door while I dish up my food and take a few bites? Like I said it was a maximum of 4 minutes from him arriving till it came out of the container that is meant to keep the heat in to a certain extent , before I started eating it

    If you don't like Manley, though, try Amerta in Monkstown. They're excellent.

    George is the man, I know and I feel bad for offending him but Manley can be a bit off with their sauces so wanted to try this place because when I eat in the restaurant part it is amazing

    Yeh are you just not reading things properly or what?

    I ordered at 8.25, received at 8.45, started eating before 8.50. Takes about 4 minutes to get to mine from the Chinese. So he left there at around 8.40. Served on my plate and began eating less than 10 minutes later after it had been in containers used to keep heat in for those 10 minutes. Not like I got it plopped it on a plate n left it for 25 minutes then started moaning

    I reckon with such a minor issue that you'd be expected to sort it out with the Chinese yourself, whatever the law actually says on the issue.

    That is of course, if you decide against taking the shoulder-shrugging, microwaving option first.

    Can I just be clear of one thing here just from the last few posts.

    I have NO INTENTION of suing the place or something haha, I'm more just wondering am I well within my rights to a refund or credit or a new meal. Looking for cold hard facts so when I ring them back up again tomorrow when the manager is in that I can use them

    Unless the take-away specifically advertises that food will be delivered to your door hot then you have no legal recourse.

    And common sense should tell you that won't always be possible.
    Looking for cold hard facts so when I ring them back up again tomorrow when the manager is in that I can use them
