I've heard both points of view.

1. Without/before food means that it has quick and easy access to your gut and, secondly, the cultures aren't killed off by the stomach acids activated when you eat something.

2. With food means that the capsule has more time to open and the cultures to spread out - accepting some will be killed off by stomach acid.
