Make sure there are no cameras recording you when you cut it off. Take the clamp with you and dispose of it, somewhere it won't be found (the bottom of a river) Then if anyone asks you say you don't know what they're talking about, you parked your car and when you came back it wasn't clamped so you drove away.

All very responsible. Even adding a bit of illegal dumping in for good measure. **** the river eh, as long as you dont have to pay for clamping.

The issue is I called the clamping place when it was clamped so I have acknowledged that there was a clamp on the car. So just wondering if I should leave the clamp now, and if ever asked about it just say it wasn't me that removed it, there is no evidence that I did it.

Um Id say if you have called and told them you're car is clamped then you're fooked. You'll have to pay up. You could still cut it off but I wouldn't recommend it. Too risky because now you can't claim that you never knew it was clamped.

Yep but if I take it off they can't prove that I did it?

Just plead ignorance if called up on

If cutting make sure there is no CCTV

If there is CCTV there ate threads on here & videos online how to take them off without damaging the clamp

I'm sorry, but what is this shroud of secrecy? People barp on about clamping being illegal and that they won't chase you in courts so why hide it when:

    1. You can cut the lock without damaging the clamp and chain. Replace the lock with a new one.

    or

    2. Pick the lock.

Then it should just be a matter of wither handing the clamp back or holding on to it for a release fee. :pac:

Them locks can be quite expensive, and it's still criminal damage if you cut it.

Some of the locks (a lot ) are disc detainer locks, which can be very difficult to pick, and a regular pick set wont be able to pick.

Just cut a link off the chain. Much easier go cut then the lock and cheaper go replace too.

I would imagine a chain is cheaper to replace than a lock? And easier to cut too?

If you are going to end up paying, at least fill the lock with superglue. They have to cut it off themselves then anyway. Damn passer by's trying to make clampers lifes difficult ;)

Not necessarily, since cutting the chain involves cutting 2 pieces of hardened steel, the lock, only have to cut one.

    only have to cut one.
Not really. Depends on the lock. They could argue that by removing a link, you have damaged the chain so you will need to replace it.

Anywho, the three of you have dodged my question. Why hide?

Indeed, that is what they would argue. The chains are pulled tight when a clamp is put on, so if you cut it, they may argue the chain is no longer long enough to fit its purpose. Also since the chains are generally welded onto the clamp, they may argue, they need a new clamp.

Hide from what, cutting it off? That's because, you are liable for criminal damage of you cut ;)

And the chances of them prosecuting when they are liable for section 113 of the Road Traffic Act? How about a disclaimer posted on your car window when you park it, stating you will not be liable for damage caused to anything which impairs the safe operation of your vehicle? It's the same means that they inform you that you may be clamped.

You could ring them up again and say "Thanks for unclamping me, I promise I won't do it again".

    If they count the links..

They will never let it go to court, for fear of losing.

Also, they could be charged in S9 Criminal Justice (public order) Act 1994.

And, yes, I do have a notice on my driver side window, and keep a grinder and inverter in the boot. I also keep a copy of the RTA 1961 (as amended in 1984) and a copy of S9 CJ (PO) Act 1994. Would like to see them ring the Gardaí, then show the Gardaí the law.
