    btw I would have been without a car for almost 2 weeks just thought off that:D
    And while I am posting an end to this looooong thread thought I would mention a guy who asked me for €50 for petrol to come and look at car as he had to travel from Ballbriggin:D

    Your posts on this thread annoyed me - I may be wrong, but apart from you taking the profiteering, dishonest side in this, I intuitively just fcuking know that if it was you as the buyer in this situation you'd have collapsed in floods of desperate tears on the sellers doorstep weeping and begging for your money back ;)

    There is nothing dishonest in keeping a deposit. It's there for a reason.

    You could say it's dishonest to sell a car while holding a deposit for someone else.

    Last time I paid deposit it was 50E on 1400E car. If the OP took reasonable amount like this, there wouldn't be a problem. 300E is more like advance payment to me, and I would give it back too. Smaller deposit like 50-100E is good enough to keep timewasters out, and if the buyer changes his mind, it is much easier to keep it without worrying about karma.

    I once had a foreign national test drive a passat one time and gave me a deposit.Then the next day they rang and said that someone got cancer and changed their mind.I said no, so actually made money on the car.Didnt believe their story.Your buyer could be genuine though.

    EDs guide to a Private Sale transaction :D

    1) If asked where can you meet them I'd always say anywhere you want so long as its within a 40 second walk back to my house after you've bought the car. If you dont make them do the work then they'll mess you around.

    2) I dont care whats wrong with it ( infact I most likely already know ) , are you buying it or not. " Okay we have a deal " or " No thanks, not for me " takes 3 seconds to say , not 25 minutes. Dont bore me with sob stories or spoof problems that you think you've found, I dont care.

    3) Test drives are with me after you've shown me proof of insurance. After that I'll bring you for a drive and you can see what you think from the passenger seat.

    4) No deposits please, you either come with the money and drive it home or you take a chance and come back with the full amount and hope its not sold. First up, best dressed as far as I 'm concerned.

    Private sales are just that, a private transaction between two people. You're not friends, neither have many rights either way and you're just looking to get your few quid in. Its not about being nice, its about selling the car and it aint sold till the money is drank :p:D

    I'd take my expenses out of the deposit and give the rest back if it were me. I know you don't have to, but I wouldn't want to profit at the expense of others. If it was just a donedeal ad and a bit of my time I think id be happy with €20 and giving the €280 back.

    Especially considering the amount, if i were buying a €1000 car and needed to put a deposit down there is no way id put down €300.

    Never asked him for deposit,he wanted me to hold the car for 7-14 days and HE wanted to put €300 down as a holding fee.
    Anyway car was sold today to a mechanic for his girlfriend took all off 15mins:)
    Deposit was returned in full to Timewaster I will call him at 12.45pm

    I lost a €500 deposit on a car that I was to purchase late in the summer, as my own car sale fell through and the bank were not happy to extend the amount that the difference would have made (the extra would have made the bank people have to go to GE money so that would be a problem), so I realised that the whole transaction was not good for me at all and that I should concentrate on clearing little things like overdraft and credit card before spending on a car again. I could have gone for it but I didn't *need* to, hence my change.

    The salesman refused to give me back any of the deposit., but as I just checked and the car is still listed as for sale for ~10k, I can't really challenge that decision.

    what is the point of a deposit ?

    surely a deposit is to discourage people from messing about.

    if people can get the deposit back then there is no point having a deposit from a sellers point of view

    I would never give back a deposit out of principle. Even on a 1k car, it's teaches the (non) buyer a valuable lesson that they will hopefully remember for the future.

    Also when taking (or giving) a deposit I have always given a written receipt for it stating the total sale price and the non refundable deposit amount signed by both parties.
