Looks like we will be needing a solicitor shortly to do the conveyancing.
With TRS ending for those who dont complete the sale by the end of the year, we are anxious to get one that is efficient and of course not expensive.
The price of the house we are looking at is around 250K, would it be possible to get one for under 2K to do this all in ?

If any one has recommendations that would be great :)
I really rather not discuss here the pros and cons of wheter to purchase now or not, its right for us at this time and stage of our lives.

    Thanks!

Can be done for a lot less than 2k. Google Robert Sweeney solicitors.

I would advise against using him. Poor communications, unrealistic and false closing dates given. I used him and still have not yet received my title deeds after repeated calls and messages being left for him. He's cheap and I now know why he's cheap. In all honesty, you'd be better off doing it yourself for a fraction of the cost. It's not rocket science and I wish I had done mine myself...

unless you bought without a mortgage you wouldnt be entitled to the title deeds.

As for doing yourself. Its impossible as unless your a solicitor as you wont have access to the land registry to do a conveyance ....

We used him too and couldnt have had a more different experience. He was extremely helpful and professional.
You do realise that the closing date has to be agreed by both solicitors and that your closing date issues probably are due to your sellers messing around?
Secondly, you dont receive the title deeds, they are held by the solicitors until closing and then sent to the bank.

I would recommend Robert Sweeny Solicitors to anyone.
I would recommend that if you are a FTB that you familiarise yourself with the buying process so you understand what your solicitor can and cannot do and have the correct expectations.

That was my experience also. I found him (and his support staff) to be very efficient and would always either take my calls or return them promptly.

Which is exactly what I did. I'm legally entitled to hold my title deeds and I was told it would take eight weeks before I receive them. Those eight weeks have long since passed.

No, that's utter nonsense. It's not impossible! It's perfectly reasonable for someone to do the searches themselves and to do the bulk of the work without the need for a solicitor, except for a solicitors signature. I previously worked as a Law Clerk and I knew of a number of people who did the conveyancing themselves.

If my solicitor tells me that I will receive my title deeds in eight weeks then my expectation is that I will receive my title deeds in eight weeks. When eight weeks pass and I hear nothing about the progress of MY title deeds and when phone calls, emails and messages left for Robert Sweeney are not returned at all I consider that to be exceptionally rude, discourteous (considering I have already paid my fees in full) and unprofessional.
This is my experience. I bitterly regret using him for the relatively simple task of conveyancing.

Hi JoeyJJ, I'm sure you must be tired of people looking for the name of that solicitor you used for your conveyance, but I would be very grateful if you might give me his name also. Many thanks,

Having went with Robert Sweeney solicitors I would just like to agree with the poster who said they communication is terrible and the service is rubbish, I have to say avoid at all costs, a few hundred extra going elsewhere would have been money well spent, he is impossible to get a hold of and delayed closing for weeks due to unavailability. Avoid avoid avoid

Not sure if anyone still reading this thread but this link will put to an end any doubts. In fairness, I used the guy, he was friendly, efficient, fought my corner for me, and his staff were good at their jobs. But when I read this story, I was taken aback. I've to employee another solicitor to ensure that my conveyancing is completed as required:

Jaysis that's pretty damning, over 200 complaints against him. People who used him for conveyancing should seriously get it double checked.

Me too, efficient up to the last few weeks before completion from about September 2012 and then things went awry. Deeds not registered, stamp duty not paid and now have to employee someone to finish the job though I may be able to recoup costs from Robert Sweeney or the Law Society - so tired of chasing my tail at this point.

Hi all sorry to throw up an old thread I am the exact same got an email last Monday stating my work wasn't complete.. Myself and partner used this solicitor in question and paid everything to him for all his services in 2012

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

I am in the same position my property has not be registered. I am wondering if anyone else is going with the solicitors who sent the email saying they could complete the file or is there anyone else you could recommend.
I would appreciate any advise as I don't know what to do now.

  • Registered Users, Registered Users 2 Posts: 32 joecreed

I have been on to the Law Society (the person I was talking to was Linda Dolan) - she gave me the name of the new solicitors who are now apparently dealing with the cases (http://gibsonandassociates.ie/) - I've been on to them & now awaiting a callback to find out what the situation is and when I can let the bank know that these guys are going to complete the processes. Is this the same crowd that you have been advised about?

We bought our house last September and our solicitor was brilliant. Tionette Ryan. She was very accommodating, very friendly and timely. Her advice was always realistic and she really knew her stuff.

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

Yes that is the firm that emailed me. I am not sure I want to use them and from what I understand we don't have to. I would be interested in hearing from you as to what you think of them when they call you back and if you are going to use them. I see they have offices in Dublin and Donegal just like the last solicitor. I was thinking of maybe going with a bigger Dublin firm. I don't want any more problems

Yes, some contact details would be very handy in case the other guys do not work out. Personally I only hope that everything will be taken care of as I've paid my money, and now am smashed - no more money to throw at solicitors to basically post some letters - I've paid my bit, got my receipt - I should not be expected to fork out yet again for something I took to be complete.

Ye i heard last week from gibson and associates regarding my file... and i am still waiting on a price from them

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

I feel the same way. I paid my money and now I am going to have to pay again and try and recoup the losses from the other solicitors insurance, but that will cost even more money.

  • Registered Users, Registered Users 2 Posts: 32 joecreed

Apparently it can be claimed from the Compensation fund from the Law Society, and interest also can be claimed, but I hear it can take som time to get out of them too. They'd be quick to send a bill if you owed them!!

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

Its an absolute disgrace the way we are been treated... the law society dont want to know i have been onto them a few times and there answer is ah u will just pay again and claim bak.. wish it was that easy myself and partner are smashed and cant afford to pay anything. The gibson and associates are dragging there heels when it comes to getting a price off them. They were on to me over two weeks ago and its my land registry that hasnt been filed so i will have to pay again for that

Too right. I don't know what I've yet to do - I havent heard from anyone as to whats remaining, or hasn't been paid. I'll end up having to borrow to pay these lot off, and then wait ages to get a claim from the Law Society too!

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

What amazes me is that the Law Society knew there was a problem with our solicitor back in 2012, and they still allowed him to continue to practice. They are supposed to regulate solicitors and protect the public.
I think that its the land registry part that has to be filed. So that probably includes the stamp duty.
I am going to look around before committing to the new Law firm. I think the Law society should have got a deal for us if we were to use the firm they suggested, as I read somewhere there are about 33 unregistered files that have to be sorted.

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

So i just recieved an email there from gibson and associates there are charging me for professional fees 600 + vat and then i have to pay outlay again which is 675 euro. this is a money spins for them i am not happy with the quote i dont know were i am going to get the money

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

I will contact them for a quote and let you know what they quote me. I think it will also cost us more money if we use them to go after the law society insurance. Maybe we should get a few quotes just to compare.

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

We have no option but to go with the new solicitor as they are charging a cancellation fee...i couldnt believe it

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

I don't remember signing any document authorizing my file to be given to another solicitor, nor did I receive any correspondence from either the Law society or our former solicitor about what was happened. The first I heard about it was in the form of an email from a law firm I had never heard of, saying they had my file and then from reading the Irish Times. So I think that it is our choice who we bring our file to. We have no contract with the new firm, so what is the cancellation fee for. I am going to call the Law Society tomorrow and ask what the situation is.

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

I rang the law society regarding this and got no were keep us posted please

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

The Law Society are not above the law. They are a body set up to regulate the lawyers and protect the public. They have guidelines they must follow. I will call them tomorrow and let you know how I get on. I did call them once before regarding our solicitor and they were not interested in speaking to me unless I wrote to them. I will write to them if I get no satisfaction when I call them tomorrow. I will keep you posted.

can you pm me the solicitors details

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

So gibson associates just got in touch with me ragarding my file and to file my land registry they have quoted me 1700 euros... like are these for real

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

I have inquired around and that is the same price I have been quoted, by 3 other solicitors, that is assuming the stamp duty has already been paid. One quote was 1500 euro but I am not sure if that included the land registration fee. I did get the name of a woman in Palmerstown who was recommended to me by an estate agent but I haven't contracted her as yet. I emailed Gibson and associates asking for a quote to complete the file but I have not heard back yet. Its hard to get an exact quote from someone who doesn't know whats left to be completed.

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

Yep all my stamp duty has been paid it was basiclly just the filing of land registry but i already paid all this in 2012 to mr sweeney.. and since then the price for land registry has doubled making it worse..when i was first contacted i was speaking to a lady in gibson and associates and she stated ah its nothing to worry about at least the main part is done and that it will only cost a few hundred... well i nearly died when i opened there email surely the law society has to step in to protect us

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

How long was anyone waiting to hear from Gibson's. I emailed them last week and am still waiting to hear back.

  • Registered Users, Registered Users 2 Posts: 34 accordsir-t

Yes it was 2 weeks or so. Were you contacted first telling you that your work hasnt been completed if so then yes ur the same two weeks i would say. This really has my head wrecked why should we be penalized for this..

  • Registered Users, Registered Users 2 Posts: 18 Ardcrann

My guess is that Gibsons are expecting us to go after the Law Society/ old solicitors mal practice insurance and they probably want to charge us for that also. They did mention in the email they sent to me that they would be able to help me recover the money, at a cost to me. If they only charge us 600 to complete the file then they probably realize we wont bother to sue, as it would cost more to sue then we are losing and therefore they will lose out on that work.
