Right first off, im not a scumbag, never been arrested no record. I thought I was being smart.

I have an umber of parking fines and no tax fines for my car, new the gards would come looking, so switched my address phone numbers and never registered them with anything since i did this. heard they knocked into my family home in wexford last wek im in dublin now.

My logic was i will be in england australia soon, if not they cant find me so cant summonce me which seems to be the case. they have no details for me at all whatsoever.

My thinking wass also u cannot serve bench warrants for minor offences which is what these are.

    :O

im point blank not paying btw because i am saving my money to leave and a few of the fines were incorrect and the civil servant usual rubbish refused to even listen to this, so i said to myself feck yas! this craphole, i would spend a week in jail if i had too to avoid paying them.
    no chance.

my plan is quite clever though no?

I'd say your wrong about the warrant, if you get fined just pay the court costs, usually €50 and you'll spend a few hours in a holding cell.

will they not lock me up? ye the warrant kind of worries me :O

but surely with the ammount of people in the same scneario but in alot worse instance.

How would i only pay 50 for the court fees? what about the 1000 in fines??
If i told them i had a unpaid bank loan would this make a difference its true.....

They wont lock you up, if you agree to pay the court fees you will be brought to what ever prison specified by the judge. You will be handed over from the guards to the prison officers and processed.

You'll have your photo taken and probably spend a few hours in a holding cell and given a dinner. The prisons are all overcrowded so instead of spending a few days as you'll officially be told they will let you out the same day, provided you pay the court fee of course.

Also, the summons can be legally served on your parents house if you have it registered as your home address.

So you don't mind them bothering your family as long as you get away with it?
    3. My logic was i will be in england australia soon, if not they cant find me so cant summonce me which seems to be the case. they have no details for me at all whatsoever.
Actually, from memory if they serve the summons by hand or registered post to your last know address, or whatever address is on the system, then it is considered validly served.
    4. im point blank not paying btw because i am saving my money to leave and a few of the fines were incorrect and the civil servant usual rubbish refused to even listen to this, so i said to myself feck yas! this craphole, i would spend a week in jail if i had too to avoid paying them.
    no chance.
If they made a mistake with the fines then just wait for the summons, go to court and tell the judge why you were only fined by mistake. Then the judge can decide if you have a good case or are full of crap.
    5. my plan is quite clever though no?
    No, it's not.

no i dont have a visa yet, but i can get one in 24 hours. I am an honest hard working professional.

for real. senior staff at my level. im not paying out of principle?
why should i have to pay fines? i wass on the dol no money some of them parking fines were on my own residence!!!! they refused to take them back.

Even once they refused to take a fine back they fined me 2 times for the same thing!!!

was waiting for the scumbag comments, but this country is a farce. and u all know it.

To be fair I don't think getting a parking fine and not wanting to pay it makes you necessarily a scumbag. I once got 2 penalty points and a fine for doing 60 in a 50 zone and I'm no arch criminal.

You won't get a visa with a bench warrant and pending prosecutions. You need a Garda certificate of clearence.

    Yeah, but you paid them?

OP, you do sound like you have a major chip on your shoulder and should you go to court I would deffo change that attitude or else the Judge will take a dim view off you and I am sure he will chuck the book at you.

look guys im no angel, i dont have much money, who says im going to australia im not stupid i know i cant get a visa with pending prosecutions, my plan was originally to go there now it looks like the UK maybe.

    I wont be coming back.

The question is , can they issue a warrant for minor offences? do u guys know the ammount of people dodging mortgages nevermind fines??

its not exactly a major offence.

the post is bouncing back of my old address they have no valid address to summonce.

How can they get me if this is the case?? I would just like an explanation?? obviously if its a criminal offence they issue a bench warrant, im not saying its impossible to do this just it would seem far fetched to me if they did this for minor offences?

why am i a scumbag? what about the scumbag gards? everytime they see a pikey they never pull them over and they drive with no insurance, I am a hard working tax payer and I/we have to go to jail for this????

i drive with no tax, i have morals thank u. as i said im no angel, if i planned on staying here i would pay them.....

the irish government as far as im concerned can stick there fines, can stick there water tax , tv licence and breathing fresh air tax, they have had enough higher rate tax from me for a lifetime.

The court will suppena you using your last known address and in your absence it will be assumed that you have failed to appear regardless whether you knew of the summons or not. You will then be fined and when the fine is not paid a bench warrant will be issued for you even though its a minor offense.

Sorry but thats how it goes.

actually smart michael, im moving for career prospects incase i lose my job in this wasteland. I feel let down by the government to the extent i never want to pay 50% tax here ever again.

Any of you with half a brain would leave too.

Taxes are not an issue, ive probably paid more than you in my life?? do I look down on you or other people for it? no?

face it, the justice system is a joke. innocent people going to jail. when you have knackers and pikeys everywhere doing what they want.

If its for several infractions I doubt you'd get away scot free but its better to show up than not, judges are lenient but if your not there they could impose the maximum fine.

Not sure about that but I would assume if the fine was for several thousand they wouldn't expect you to have it in your back pocket. I'd say more likely you'd be given a deadline to pay it by.

How ??? ... if a warrant is issued they have already got summary judgement against you for non appearance, the next time you appear before a judge in an Irish court will be to answer the bench warrant.

then you can deal with the non display of tax and other fines you have gotten !!

-to me it sounds like if you do manage to leave the country you could face arrest if you come back (even for a holiday) .... hardly worth leaving your entire family for is it ???

See i dont think they can summonce me , on an address where they actually bounce my post away. the postman apparently has been told. i dont live there.

why would they be looking for me if this was not the case???

If I'm right its not the guards that summons you its the court and although a summons used to have to be given in person it can now be done through the post, if they dont receive confirmation that you will be there or you dont turn up you'll be prosecuted in your absence.

The postman doesn't deliver a summons. The garda does. They can serve it on your last known address. If you don't appear in court the judge will talk to the Garda and make a decision on wether to a) issue a bench warrant, b) proceed in your absence or c) set a new date and allow the Gardaí to try notify you again.

If your out of the country and never returning the not going to issue an international warrant but if I was you I'd leave a clean slate in Ireland just in case you ever do need to return. ie visiting family, attending funeral.

Plus it would be tough knowing you can't return to the country you were born in with that type of thing waiting for you.

Maybe he'll be lenient but I'd definitely show up. If you get the fine try to do the court costs thing, its a bit of a joke having to go to prison for a few hours but you'll only be in a holding cell not the main prison.

I got a lift to portlaoise had me pic taken and was given a dinner I had to eat with a plastic knife and fork and the fluckin fork broke.

Was for a petty fine €450

I paid €100, I didn't know the court costs was only €53 or something and the gits never told me, I could of saved meself €50. You get given a free bus pass home to.

How do you expect to leave the country with no documentation.

Let it go to a bench warrant if you want. If you ever return you will be arrested and kept for court. The Gardaí will object to any future bail as you are a clear flight risk and you will most likely receive more charges.

  • Registered Users, Registered Users 2 Posts: 44 ollib1984

Seriously, why should I have to pay? being bullied with pathetic fines and escalation fines going from 30 to 120 per fine then to court.

I genuinely had no money, genuinely fined incorrectly a couple of times and twice for the same offence!

I am bloody shattin myself at goin near a prison, but im just standing strong. ill try wrangle my way out anyway i can. but if i have to go. ill gol
