Car I Sold

I am 15 and i sold my field car 6 months ago because the clutch was gone. it was SOLD AS SEEN. At the time, the fella who was looking at it questioned the tax book. I told him that I never had one because i had no need for it. The garage that i bought it off is now closed down. When he collected it i went on the net and printed him off a form for a lost tax book (out of the goodness of my heart)
He pain 300 for it and says that he spent 200 on it. he now says that he cant get the tax book and wants me to get a tax book- which i have tried and cant get. or else take it the jeep back and pay him 500. im 15 and lucky to have 50 euro never mind 500.
What position am i in, will i have to take it back?
    Thanks

He can get a form filled out to take ownership of the car. I can't remember the form number but the tax office in Ennis can help.

I had to do this for my motorbike - it didn't have an ownership cert with it and I couldn't get in touch with the original owner. It's now registered as mine.

He knew the deal before he bought it. He should have a bit more sense to be quibbling about a car with a 15 year old, that was used for ripping about in.
I wouldn't be taking it back for starters, but some of these people can get agressive so i'd consult an appropriate adult to give you advice on this one, good luck.

If you are telling the full story then this guy is an ass.
Offer him €50 for it due to it only being good as a field car. That should wind him up nicely

Are 15 year olds legally allowed enter into contracts?

    I think not.

You may have to take it back on the basis that the contract to sell and the contract to buy is null and void??

I'd say that might be beyond the reasoning of someone who would
    a) buy a knackered field car from a 15 yr old
    b) buy a knackered field car from a 15 yr old without any proof that the car ever belonged to the 15yr old, or could be properly transferred
    c) buy a knackered field car from a 15 yr old without any proof that the car ever belonged to the 15yr old, or could be properly transferred, and proceed to spend 200yoyo on it and expect a takeback 6 months on...

What contract to sell? What contract to buy?

    Prove it

Those were the days, ripping about the roads and fields in a clapped out old car. Usually ended in the car being wrote off or damaged beyond repair tho. Any fool buying the car knew what it went through!

They enter into a contract of sorts when they buy stuff in a shop. Don't see why this would be any different.

Apparently minors are allowed enter into contracts if for everyday essentials or something?

He paid you E300 and he wants E500 back?
That guy is a crook and a scam artist.
He thinks because you are young he can bully you into paying up.
No matter what lies he tells you, he hasn't got a leg to stand on.
If he threatens you with solicitor, etc... make sure you have a card from your solicitor ready (just any old business card will do, he's bluffing, double bluff him) and tell him to direct any further queries in this matter to him.
That'll be the last you hear from him.

  • Registered Users, Registered Users 2 Posts: 10,992 ✭✭✭✭partyatmygaff

He has nothing on you. You don't owe him a cent and shouldn't have to even entertain talking with him any more.

He may say that, but he bought the car as seen.
If the engine falls out as soon as he's off your drive, it's his problem.
In fairness, anyone who buys a car for that amount must expect there to be some work to be done.
If the clutch cost him 200, it's not your fault, as seen means exactly that, whatever goes wrong is the buyers problem and at the end of the day, it's a field car, what does he expect.

This. Tell him to stop ringing you, he isn't going to get a cent back. Will be a good life lesson for both of you.

Did you mention when you advertised it that there was no tax book and all of the faults? He definitely should have not paid anything until it was sorted first.Buying privately the buyer is taking a risk.Yes for that price, there is bound to be faults.6 months down the line, is asking a bit too much for money back though. You really cant be sure with some of these people, they could come back with heavys to do you in, or maybe burn you out of it, so just be careful.

Just out of interest, why cant you get the logbook? Is it because of your age? if so could the previous owner not get the taxbook?

  • Registered Users, Registered Users 2 Posts: 23,694 ✭✭✭✭L-M

Ring the Gardaí, tell them some weirdo keeps harrassing you saying he bought a car off you and wants 500 euro back for it, you're only 15, couldn't of possibly owned a car...

Also put on an extremely nervous voice and tell them you're scared for your life...

    That should solve it :L

Not sure if thats even true. I had ownership of a car transferred into my name when I was 14 from a gard of all people! I had the log book and all that jazz in my name. That was 16 years ago mind you!

Funny enough I had a chancer buy it off me too, I was having none of it though. It was a '79 Audi 80. Hilarious. He dropped oil on the ground off the dipstick then later claimed there was a leak. Tried all kinds of stuff in the end, claiming the brakes didnt work and all sorta stuff. Sucker bought it for asking price in the end, then came back later and asked why there was no wheel brace. Told him I sold him a car, he can get his own wheel brace and to **k off.

OP the bloke is having a laugh. He bought the car as seen. Once he paid for it, became HIS car and they are now HIS problems. I doubt anyone with some sort of baydboy clout would waste their time on something like this so dont worry too much. Just keep telling him "but its not my car" over and over, he'll probably get fed up eventually. If he persists I guess you could report harassment to the gards. Im lovin the report it stolen idea though, thats genuius!

I didn't mean it as in possibly by law, I meant "Oh I'm 15 and I've no money" kinda plea.

Tell him the car market is gone to crap, and you've sold 15 other ones like that only recently, all went for only €20 each, but seeing as he put a new clutch in it that you'll give him €25, or €30 if he has the log book with it... and if he doesn't like it, then he can take his clutch and piss off...

  • Registered Users, Registered Users 2 Posts: 24,537 ✭✭✭✭Cookie_Monster

who's car did you sell him since you can't legally own one?
Did you have the owners permission?

Aside from that he has no comeback if it was sold as seen and was agreed upon.

There is no minimum age to own a car. There is only a minimum age to drive the car on public roads.

Technically speaking a twelve year old could be bought a Ferrari and they could drive it around provided it was on private property without access to any public roads.
