Stopped for no tax

    Was stopped for having no tax last week and the guard said there would be a fine to pay in the post office
    Are they not supposed to give you some documentation at the time?
    he never gave me anything
    just wrote some things down in his notepad

    Something special about you to speak for every motorist in Ireland?
    I'm sure even a simpleton can understand that we all have different personal circumstances and in this recessionary times that we live in feeding my kids and clothing them takes preference in my life at the moment
    I still need a way to transport them to and from school/nurseries etc.

    You're actually fortunate. Depending on how long the vehicle had out of date tax, the Gardai had the power to impound your vehicle.

    Yes the OP should have had tax on a vehicle in a public place, majority of the adult population know that.

    OP unfortunately the Gardai don't have to provide you with anything. This is unfortunate for both you and the Gardai. It is a major fault with the current FCPS system that motorists, Gardai and Judges hate!

    A few years ago a few civil servants and high ranking Gardai decided that there was no need for a chain of evidence and opted out of handing the motorist a fine and also opted out of the only other alternative - providing the motorist with a fine via registered post.

    For some it means getting away with penalty points if you're willing to purge yourself by saying you never got the fine via ordinary post but when it comes to tax there is no avoidance.

    I have absolutely no problem paying the fine, just thought it was a little strange that i wasnt giving any doumentation at the time

    Delighted to hear it... always felt sorry for the Corps in that anyone can legally get off with the work they do... it's a disgrace of a system.

    While we're on the subject, do you still have a month in lieu to pay -e.g. if you want to renew for 3 months, and your tax expired this January, do you have until end of February to pay up (but it means it will still only run for the original three months)?

    I don't believe you ever had a month. If your tax expires at the end of January you are supposed to have it renewed asap. Most gardai are nice and will ignore it if it has just been out of tax with say 10 days, most people think they have a grace period because of this. If your tax runs out for a month you can pay in arrears.

    If it ends in January and you go along at end of feb and get it tax for the 3 months, you are paying the tax for the month of january alright but if you get stopped near the end of feb without valid tax then you can get in trouble about it.

    you have 10 days grace on car tax so you can be without car tax for 10 days from last day your covered and if caught the guards will tell you to get sorted and show proof at local garda station within a time frame. seemingly if your tax has expired for 3 months or more the guards can seize your car there and then so count yourself lucky and pay your tax!
    it is a pain in the ass tho considering we already get rode on the price of cars, petrol, insurance etc givin the state of most of our roads but a necessary evil non-the-less.

    i drive a 2 litre car, tax for year 600+, fine - 60
    im clever enough to beat the system
    tax for 3 months 140, dont tax for a year maybe get a 60 quid fine

    hmmmmmm, i pay a lot of taxes and motor tax in my opinion is not worth paying seeing as the roads are so bad and this government dont deserve my taxes

    My priorities are more than right

    Can't because it doesn't exist. There is no grace period which allows you drive without motor tax, in fact the law says it's an offence to do so.

    All that means is that you have until the end of the month to pay without incurring arrears. For example, if you pay for 3 months tax in Feb you're charged the normal rate and taxed until 30th April. If you pay in March you'll have to pay for 3months from the 1st March and pay arrears @112% for Feb.
    At no stage are you allowed to use the car without tax so if you were stopped sometime in Feb before you renewed you could be liable for the fine.

    You can avoid arrears if you did not use the car at any time and make a legal declaration to that effect in the presence of and witnessed by a Garda.

    Don't tax the car, and it's out over 2 months, then you're car will go on a little holiday to an impound lot. Where to get it back you will have to pay the €140 to get it taxed, so you can legally drive on the public roads after you've paid the €125 towing charge, and €35 for each day the car is stored in the impound lot. All this has to be paid to get it released back to you. Then you'll have to pay the €60 fixed charge penalty. So even if you stump up straight away it'll cost you €325 at least. Your plan is not as clever as you may think.

    If it goes to court and goes against you then you run the risk of the fine increasing significantly.

    By the way if you go into a Garda station and declare the car was off the road for the period during which you were stopped you run the risk of being prosecuted for making a false declaration, I wouldn't go there if I were you! You bright idea might not be so bright after all!

    Three things....

    1: Your punctuation is terrible!

    2: Share your " surefire and legal way around this ", :rolleyes: because I want to know how I could have avoided paying over €500 tax today and every other year that I have been paying it!!

    3: On the up side, all of this money you are " saving " will come in very handy when you have to hire a solicitor to defend the imminent RTA charges that will be brought against you, as a result of your sheer ignorance!!!

    Please enlighten us as to this magical legal way of avoiding tax, so we may debate the legality of your scheme.
