This whole idea seems like legal minefield, if I came out to my car and it was clamped regardless of telling me I had won €100 I would be enraged, surely clamping in a public place requires a license?

Look at the image, it's only wrapped around the front of the wheel on a single chain, and is effective as a pink spandex jumpsuit is at hiding one's crotch.

It's a novel bit of pr and fun to boot. Untwist knickers kthxbai.

It's unregulated on private property, these clamps look to be placed on public property, ie the side of the road which requires a contract from the local council as it's council lands.

Steal the clamp and ransom it to them for 200 Euro.

  • Registered Users, Registered Users 2 Posts: 3,332 ✭✭✭Guill

I'd murder the pink fanny if he did that to me, 100euro and late for work..get fired...on the dole..lose house...lose wife kids...sleep on street...sell body for heroin...etc etc.

    Slippery slope

They should just stick a crisp €100 note under your wiper, would get a very pleasent reaction from me anyways :D. A scantly clad lady dressed sparingly in pink clothing could deliver it.

scantily clad ladies normally do have to dress sparingly, in order to be scantily clad.

Its not even a proper clamp. It looks like a bit of cardboard with a chain on it.

Find something important to be engaged about.

Eh, the cars aren't actually clamped. It's just sitting on the wheel - it isn't even attached. Looking at the photo for 1 second will tell you this. DUH! So if you find one on your wheel, just lift it off and drive away, so you can go be miserable on your own somewhere.

I'm going to simplify this for you:

    1. Some people don't want that sh1t on their car.

    2. It's quite possibly illegal.

  • Registered Users, Registered Users 2 Posts: 1,466 ✭✭✭Forest Master

    Anan1 wrote: »

I know that - but that's not what I was saying, so you're not even replying to my point. I'm pointing out that it isn't "clamped". It's a bit of cardboard placed on the wheel - no lock, and no restriction whatsoever. It's not going to affect anyone or delay anyone.

Did anyone even look at the photo, or is it all just outraged bandwagon jumpers?
if I came out to my car and it was clamped
    The car isn't clamped.

You don't have to chase anyone - the car isn't clamped. You can just drive off.

    They're not clamps.

Get it yet? The whole "clamped" discussion is moot. The car isn't clamped.

There are chains on them and while not attached securely like a normal clamp if you were to jump in the car and drive without removing them they would wrap themselves around the wheel and cause damage. If I can't drive my car 100% as I left it without having to move, remove or alter the car from the way I left it in order to drive off then my car has been interfered with by someone without my permission which you will find is an offence.

Again - missing my point - should I repeat it for the 11th time? THE CAR ISN'T CLAMPED. So stop using the word "clamped".

And if you were dumb enough to drive off without seeing the huge pink notice on your drivers window, then maybe it's just natural selection taking it's course. Or did you miss the pink notification slip too?
my car has been interfered with by someone without my permission which you will find is an offence.
What's the specific offence, considering there has been absolutely no damage?

  • Closed Accounts Posts: 9,534 ✭✭✭SV

Well then why use a clamp?

    Again, stupid idea.
It'd be left on the road if it was on my car.

    That craps annoying.

That's exactly my point. You're not clamped - you can just lift it off & drive away. It affects nobody, and there has been no damage or delay to anyone involved in any capacity.

  • Closed Accounts Posts: 10,910 ✭✭✭✭RoundyMooney

One assumes the spandex lad waits with or near the car, and is caught with ease.

Ok from your point of view if someone placed a nail under each of your tyres that would also be no damage...until you actually drove away

Also the drivers window has been covered making it hard to see out of......

(that has to be an offence or else i am going around painting car windows tomorrow).

Comparison fail. It's not the same thing at all, and it's skewed logic. In your "comparison", you're omitting the pink slip on the drivers window, the prize, the visibility of the "obstruction", the guy in the pink suit who would most likely stop you driving off, and the lack of any malicious intent.

Nice try though. I think you need to find more important things to be concerned about, than people giving away money for free using a completely harmless promotional gimmick, which isn't illegal (still waiting for you to tell me the "specific" offence, BTW) - maybe go find those Cheryl Cole haircut pics you were originally looking for, or read Justin Beiber's blog or something...

Yeah, because it's stuck on with super-glue and completely unmovable...

  • Registered Users, Registered Users 2 Posts: 3,332 ✭✭✭Guill

By your logic, it is not the act that is an offence but the severity of it. So if i met the pink wanker at my car, i could hit him a thump and i could argue that as i didn't hurt him badly there was no offence???

Can you explain how this logic expands into larger areas such attempted murder etc....

  • Registered Users, Registered Users 2 Posts: 7,401 ✭✭✭Nonoperational

Are people serious? It's a free €100. The clamp is just for show. Jesus.

I would love 100 euro, the Op's question was is it legal? Regardless of prizes or type of clamp etc.

Jeeze lads calm down. It's a little promo gimmick with a fake clamp, why get worked up about it?

  • Registered Users, Registered Users 2 Posts: 22,815 ✭✭✭✭Anan1

OK, let's forget about the €100 for a minute. If someone were to put the same sticker and 'clamp' on your car, but without the offer of money, would you be ok with it?

    No.

I can't imagine many people would. So what this really boils down to is that some of you are prepared to accept it for €100. That's fine, but realize that others aren't.

  • Registered Users, Registered Users 2 Posts: 2,005 ✭✭✭Cionád

If the clamp isn't actually attached, as it appears in the photo, and the sticker is not one of those that take years to remove, you can just drag the chains away, rip off the sticker, and you're gone in seconds.
I might not be happy and it would be slightly inconvenient, but it's not going to ruin my day and it's nothing to call the Gardai about.

Eh, my logic doesn't imply that at all. You can't just say "by your logic" and then make something up.
Spin aren't commiting ANY offence whatsoever - thumping someone is an offence.

I wouldn't be so sure.... that window sticker could be considered advertising, sure isn't that the whole point of the campaign.
Sect 19 Litter pollution Act, 1997
    (2) A person shall not place advertising material on a mechanically propelled vehicle in a public place without the prior consent of the person who owns, or is in charge of, the vehicle.

I have to say I agree with nearly everyone in this thread :D.

If the clamp isn't properly attached and the sticker is easy to take off, it's not going to be something the Gardai give a sh1te about and it's probably not something to get bent out of shape about...

...however, if I came out of somewhere and found these things affixed to my car I'd find it hard not to get relatively frustrated.
IF this stuff was stuck to my my car and the guy in the pink gimp suit was easily within sight and already holding a cheque for €100 with my name on it, I'd laugh it off.
If I found the stuff attached to my car and there were further steps I needed to take in order to claim the €100, I'd probably just pull the crap off my car and throw it in the nearest fountain/bin.
If I found my car was actually immobilised, I'd be absolutely livid and would call the Gardai long before I called whatever promotional phone number is probably detailed on that stupid sticker.

I worry more about what my elderly mother or father would think if they came out to find this crap on their car - I'm sure I'd get a panicked phone call seconds later.

I hope these things have been thought through and accounted for.

they probably only target skangermobiles anyway, cuz they're the only ones who listen to that sh1te

I don't see any competition specific T&Cs on the website, but from the video:

It looks like it's a proper metal clamp & lock rather than some cardboard prop yoke

    131346.jpg

And it looks like you have to call Spin to get it removed or to further participate

    131347.jpg

Hopefully they'll do something to let you opt in (like only clamping cars that have the Spin sticker in the rear window), rather than just clamping random cars.
