No Angel?

Nadja Benaissa, singer of German girl band "No Angels" has gone on trial accused of causing bodily harm by having unprotected sex despite knowing she was HIV-positive. One guy has claimed she infected him with the virus in 2004.

I think she should be charged almost in the same as a drink driver gets charged. She has knowingly endangered lives and in fact possibly caused someone's death.

I am conflicted though, as she is quite hot and I want her sexually .. protected of course.
A German pop star told a court she was "sorry" Monday after admitting to having unprotected sex without telling her partners she was HIV positive.

Nadja Benaissa, 28, was appearing at a court in Darmstadt, near Frankfurt.

The former girl band singer is accused of having unprotected sex on five occasions without letting her lovers know she was infected with the virus, which causes AIDS.

One of her partners was subsequently confirmed as being HIV positive.

Benaissa is facing between six months and 10 years in prison.

The ex-member of all-female pop group No Angels, was arrested last April and charged in February this year with causing bodily harm.

According to the charges, she had unprotected sex on five occasions between 2000 and 2004 with three people.

The verdict is due on August 26.
Should some responsibility lie with people (the guy(s) in this case) that choose to sleep around and have unprotected sex?

Or is it totally up to her to declare to guys she is about to have sex with, that she is HIV?

Do you think she should go to prison, and if so - for how long?

She should have to tell whoever she is with, guys have to (or are meant to disclose this bit of info before doing the deed) so should not be any different for girls

Anybody post a photo of her?

10 years in prison. i'd have said life, because she should have told them, but at the same time they should have worn a rubber. only a gobshyte doesn't use condoms with a stranger.

Where one individual knowingly does wrong, then they are 100% liable. Where the wrong is accidental, then you can feel free to divvy up the blame and tell everyone how they could have been safer.

In this case, she failed to disclose some material information. Blaming the guy is a bit like blaming a pedestrian for not getting out of the way when he got hit by a drunk driver.

It does however illustrate to guys that no matter how hot the girl, no matter who she is, if you're not 100% sure of her past, then suit up before going into battle.

Yes, she should go to prison, how long, I don't know.

It's reckless endangerment probably. It can't be manslaughter because nobody is dead (yet). The key is probably that there was no intent to harm on her part, and no guarantee that her actions would result in someone being infected. However there was a very real risk that her actions would result in serious harm to another.

In fact, the odds of a man getting HIV from vaginal intercourse with a infected woman are quite low, 1 in 2,000. So I imagine her defence will probably hinge on his sexual habits - how many other women he's been having sex with, whether he's bisexual, etc. Winning a legal case is all about reasonable doubt; If it can be shown that he could have been infected by someone else, then that means there's a good possibility she is not guilty.

If she's guilty, I would take a sizeable amount of her assets and income (i.e. everything bar what she needs to eat) and use it to treat the guy that she has infected.

10 years would be much better. With aids I'm not sure how long she's last inside though health wise.

it's her responsibilty. i cannot believe someone, presumably educated, would do something like this. unless of course it was done to purposely infect someone.

Isn’t that the great thing about the tabloid newspapers in England.
If she was English, and no sooner that she found she was HIV+ then it would be all over the tabloids, then everyone would know not to go near her.
That’s what I like about the tabloids, it keeps me safe knowing who has what, not that I would have a chance with her.

She should insist on her partners using protection. Is that so hard?

She doesn't necessarily have to come out and say she has AIDS but she should tell a guy she's about to have sex with: "use a johnny or gtfo".

  • Registered Users, Registered Users 2 Posts: 3,739 ✭✭✭johnmcdnl

she had sex with 4 guys and 1 of those guys ended up with aids - how many lads did this lad pass it onto as well - i think she should be held responsible for these guys as well to some degree but the guy should have to take some stick if he did pass it onto anyone else...

like what sort of person would have unprotected sex with someone if you knew you had HIV...

I dont think she should be exchanging any bodily fluids with anyone if she has hiv+.what if a guy had a few open wounds. You can catch hiv+ in more ways than through your micky.

you got hiv+= no sucky fcuky full stop.

There should really be a completely new law drawn up for this kind of thing. Not only did she endanger whoever she slept with, but also whoever they went on to sleep with

Life imprisonment seems about fair for such a horrible act

  • seamus wrote: »

whilst not the death sentence it was Aids is still a fatal disease and the infected sustain a poorer quality of life on a numerous cocktail of drugs which can leave the carrier open to other infections which they cannot fight such as pnemonia.

anyone who has aids also faces difficulty in gaining and or maintaining employment and is unlikely to be able to get insurance life or medical .

so whilst she didnt directly kill them she may of well of done .

Aids is now growing as fast amongst young hetrosexuals in europe as it is in the homosexual population.

    wear a condom .

AIDS isnt what it used to be.

    Yeah, wussy modern day AIDS.

Pretty much the same as getting a cold now. In my day AIDS would kill an entire family in 15 minutes after their next door neighbour contracted it.

    That's just it.
I have a friend who is HIV positive.
He had a long relationship with his ex girlfriend and she never contracted it.
As long as he takes his medication every day, then all is well. The chances of him passing it on are extremely slim.

They constantly had unprotected sex. She knew of his HIV. They were together for 5 years. He took his aids pill, she took her contraceptive pill. No aids and no unwanted kids.

He has been living with it for about 8 years now and is otherwise completely healthy.
It's not 1984 any more. We know more about it these days. I know that I'm not going to catch it if he calls over for a cup of tea and I don't wash the cup with bleach before using it again.

You have a far greater chance of catching the dreaded herpes simplex (about 80% of people have it in their blood) by kissing someone, than you have of catching HIV from an infected person who is responsible about taking their medication.

Before he told me about this I too would have called for this woman to be jailed, but I have since educated myself on the subject.
Ignorance is far more dangerous to society than the virus.
In the words of my late, great Father. "Use a ****ing condom".

In saying that, if she was aware and had not been taking her meds, then she's a **** for not telling these people.
On the other hand, they were stupid for not using protection.

We're all aware of STI/Ds. If you're willing to have unprotected sex with a stranger, then you know that you are putting yourself at risk.
I've quite a few friends who had to go the the clinic in James's hospital after a one night stand. Some blamed the person they had sex with. The others recognised they were to blame for not using protection.

Remember that HIV is no longer a death sentence.

As said already: a decent sentence (up to 10 years) and she should foot all the medical bills indefinitely.

What a shitty thing to do.

Has it been confirmed that she gave this dude HIV?
Is it a tin of beans case?

While the lads were fairly stupid in not wearing a johnny with a young celebrity who you knew had been around the block, the onus of blame has to firmly placed at her feet.

It was over a timespan of 4 years which I think is a disgrace. She very clearly in that time did not mature or deal with her disease. Ten years is a perfect sentence for her.

  • Registered Users, Registered Users 2 Posts: 1,617 ✭✭✭Cat Melodeon

She was first diagnosed with HIV in 1999 when she had a routine blood test during pregnancy. She was 17 and decided not to tell anyone, not even her daughter (who does not have the virus). It would appear that she has been in denial ever since.

It has not yet been proven whether the infected former lover was infected by Banaissa or by another partner.

A previous case in Germany saw a man sentenced to five and a half years for the same thing.

  • Closed Accounts Posts: 788 ✭✭✭Sound Bite

At the risk of sounding like my mother, if you lie down with dogs be prepared to get flees!

Anyone sleeping someone they don't know/trust, should you a condom. simples. There also has to be some sense of personal responsibility.

Both responsible but she's some bitch for keeping it from him.
