Litter Fine

    Hi there,

Got myself a litter fine in the post today addressed to me using my car reg. Thing is I was at work at the time but it was probably my brother or sister driving the car. Now, given that they would have to pay the fine, neither of them are admitting to driving it.

Any point complaining to the council about being at work or will they just give the "Owner of the car is responsible" line?

Does this mean I can just call in anyone that flicks a fag butt out the window and expect they will get a fine? - what's the number?

If it's your car let neither of them drive it until the fine is paid.

Maybe they were complementing you on your littering technique. Room for improvement though.

Could be wrong but is the fine in your name or just the car reg stated?
If you can show you weren't driving but elsewhere at the time, you might stand a chance of getting off.

Otherwise, if the hassle of proving all that is too much, I'd be tempted to shove it in front of the person who was littering and tell them to pay it or they will never get the car again!

Just don't let anyone else drive your car in future.

If you allow various people to drive it then yes ultimately it is your responsibility.

The people who littered are responsible, it doesn't matter that they were in a car at the time or whose car it was.

If the OP allows the car to become a mobile litter sprayer then IMO it is his/her responsibilty to deny the litter-thrower access to the vehicle.

People seem to be happy to chuck rubbish out of a moving car (particularly cigarette butts which i find disgusting & annoying) but wouldn't think about it if they were walking down the street.

People who flick fag ends out of car windows should be dragged out of the car & slapped around the face for a few minutes. Then given a wedgie & then a final good solid kick up the hole sending them back into the car.:)

Could the council have made a mistake with the reg number?
I'd tell them that you were at work, the car was in the carpark & you have no idea how you could be done for littering because you were working.

And then I'd chop the hands off your brother & sister so they can't do it again.

What condition is the car in ?
Maybe random bits are falling off it.

No it isn't, if the car had been used in a drive-by would the OP be done for attempted murder?

It is often legal to lend a car to a fully licenced driver once you have the right insurance, you aren't liable for their littering, inside or outside of the car.

Yeah then they'll say, do you allow others to drive your car?

And that'l be the end of that argument.

And that'l be the end of that argument.

And the obvious answer to that is: 'No, I don't allow anyone else to drive the car'.

best thing to do is ask them for what proof they have - explain to them that you were in work at the time of the alleged offence and could not possibly have committed the alleged littering.

its more than likely they will not have any proof it was you - and if you can prove you were in work...they cant blame you.

(note: dont bother saying it could have been your brother or sister, 'cos for all you know they could have borrowed it and given it to a friend to drive.... so john random could have been driving at the time)

Well if the OP had said that someone had driven his/her car & killed several people with a machine gun & recieved a fine in the post for it then you might have a point & be on-topic.

Really? Fair enough, lets see some back-up information to support what your saying.

If I just pick a car at random and report them for littering will they be fined?

Nope, they'll give you the "Owner of the car is assumed to be responsible unless the owner can show who was driving". The same would have happened if your car was caught speeding.

And as already stated, tell them to f*** off if they ever ask for the loan of the car (or anything else) again
