I bid on a chainsaw, and am the winning bidder, but the seller now says "hi sorry but did not get what i wanted for saw sorry". Did we not have a legal contract, as I am reminded every time I bid ?

if there was a reserve price that was not met he does not have to sell if there ws no reserve contact ebay and report him, they will sort it out

  • Registered Users, Registered Users 2 Posts: 6,304 ✭✭✭bonzodog2

No reserve price was mentioned (obviously I don't expect the listing to say what it is ...), but surely if there was one, I should have been informed at the auction end; I think I've had some message before like "The bid did not meet the reserve" etc
Seller has only 9 feedbacks, 1 of which is he didn't pay for an item.
I haven't paid for it yet, but MyeBay seems happy to let me

you would see on an auction after you bid (before the bidding ends) whether the reserve has been reached or not.

that seller obviously didnt not know how to setup the auction... not your fault.

Report the seller for Seller Non-Performance (http://pages.ebay.ie/help/policies/seller-non-performance.html) and leave negative feedback. Simples.

  • Registered Users, Registered Users 2 Posts: 2,699 ✭✭✭samhail

you could consider emaling the seller and say that there was no reserve on the bidding and if they arent going to complete the sale then you will leave them bad feedback
... though if they only have 9 feedback they probably dont really care.

    +1

If the seller is genuine then this will be a concern for him.
If not, then I wouldn't go buying anything from him.

If they only have, that may be more reason they would care 'cause a negative sticks out like a sore thumb when you have low feedback.

Now he says he wants 65 GBP postage, having agreed before I bid anything that I could collect in person. I haven't paid him, so I can't leave feedback

Do you have the correspondence where ye agreed that you would collect it. Just remind him of that and send him a copy. If there is a dispute you can contact ebay and they sometimes try and resolve it if neither parties can.

You could be nasty and set up a bogus ebay account for his future auctions...

Sorry, shouldnt suggest that, very very bad...

You most certainly can leave him feedback. If he's a PowerSeller, you may not be able to leave him feedback for 7 days, otherwise, I believe it's 3 days.

I've just noticed that he had this item listed before. It reached a lower price than I bid.

  • Closed Accounts Posts: 2,045 ✭✭✭ttm

I had this recently with a seller that didn't want to sell at a very low hammer price. He even emailed me and said "sorry I'm not prepared to sell at the price", so I left negative and moved on. I said something like, "Won at low price, paid instantly, refunded, seller refused to sell", all quite factual. In your case its much the same, "Won, seller refused to sell then tried to inflate shipping cost."

In which case he's probably done the same before so leave that negative and do other buyers a favour.

People are far to afraid to leave negative feedback which is bad as it makes eBay look alot safer than it really is!

To be honest I would just leave it go. He is totally in the wrong.

He doesn't very honest. I would be seriously concerned that you could pay and get no chain saw.

But why as a buyer if you know the sale price and have agreed a shipping cost (or local pickup) wouldn't you pay as soon as the auction has finished? Unless of course your paying cash on pickup?

Does leaving it go include not leaving feedback?

Buyers can't receive negative feedback so I can't see a reason not to leave negative feedback for a seller in this situation. You have to sound off like you've got a pair.

but if you go too overboard or stray from verifiable facts, the sellers seem able to contact ebay and get the feedback deleted.

It's very rare though, and you'd have to have done something like left profanities or a link (links are not allowed in feedback).

Since you can't actually force the seller to go ahead, all you can do is leave negative feedback, something like "Seller refuses to sell at winning bid" would suffice. Also report the seller for non performance.

I recently had a comment removed (it said "item never arrived, rude communications - which was true) and it had none of those things. Seems to be on a whim of whatever staff member the seller speaks to

I would leave feedback of course.

Was that a first instance of the seller getting a negative? I know for non paying stikes its easy to get the first one removed after that your on you own so wonder if its the same for the first negative feedback?

  • Registered Users, Registered Users 2 Posts: 6,304 ✭✭✭bonzodog2

Update: the seller later told me via text (still don't know where he got my number) that he'd post it for 15euro. I replied that I'd rather pick it up in person, the guy I was buying it for rang him and agreed to meet him the following night. Then seller texted again to say he was relisting the item. Now he is no longer a registered user !

Report him to ebay and leave negative feedback.

Good to get an update, it sounds doubtful if the item ever existed in the first place.

Annnnnd how would he do that?

Report and leave negative feedback. You are better off not dealing with this seller.

    Edit> Hint....
Now he is no longer a registered user !

IIRC it was the 1st negative and he had a high feedback.

Seems another case here of someone coming on and ignoring the very reasonable advice given. I would have reported for non selling and left negative then moved on.

He probably got it off your ebay personal details. You can request the personal details for anybody you have done a transation with though ebay, you would have recieved an email with his details as well.

Interesting advice? How exactly other than leaving negative feedback do you report a seller? If I've missed the pulldown menu for reporting this please point me in the right direction.

Open up an INR (Item not received) dispute.
