    That is the result of stop gap legislation which was brought in, in 2006, it was said it would never be used in a case like this. It being brought forward now must be so to get it changed. It is wrong and it does need to be addressed it was ill tought out stop gap legislation after the challenge on the lack of plea of mistaking a girls age in case of statutory rape.

    I agree. I had a look at the OP a few hours ago and didn't feel compelled to respond. I felt the issue was being covered pretty well in AH, and I didn't have anything to add. I'm sure virtually everyone wants the boy to win his case, but not just for reasons of anti-discrimination.

    I think looking at this only through the lens of 'discrimination' doesn't make a lot of sense, unless you believe both youths involved should be charged.

    If you believe neither should be charged, then it's the fact that consensual sex between teenagers is a crime is the issue here. Of course the gender discrimination is also a bit bonkers, but it's secondary.
