You can't make a citizen's arrest just because someone is probably breaking the law. There has to be a real risk of flight and several other factors that mean a citizen's arrest is the only option.

    ***********Serious reply alert*********

I dont think taking a sick day when your not sick is a criminal matter, so I dont think you could try to claim citizens arrest, if you caught one taking the day off!

if my house gets broken into who am I gonna call to come over 60mins later and write down a report? Its my right as an Irish citizen to be 'protected' by a police force.

No. The power of arrest by a citizen is stated under s 4 of the Criminal Law Act 1997.The offence must be an arrestable offence; meaning one that carries 5 years imprisonment or more.
The arrested person has to be handed over to the Garda as soon as possible, and the arrest can only be made if the arresting citizen believes that the offender will avoid arrest.

You might want to check into that, you'll find that your statement above is incorrect.

I sir call you a braggart and a liar. Sixty minutes in completely unrealistic, a day is most likely. After having a Van and a house broken into this joke always reminds me of the guards.

George Phillips of Meridian, Mississippi was going to bed when his wife told him that he'd left the light on in the garden shed, which she could see from the bedroom window. Upon closer inspection, George could see that there were people in the shed stealing things.

He phoned the police, who asked, "Is someone in your house?"

    George said, "No."

The police then said, ""All the patrols are busy. You should simply lock your door and an officer will be out within an hour or so."

George said, "OK," hung up, counted to 30, and phoned the police again. "Hello, I just called you less than a minute ago because there were people in my shed. Well, you don't have to worry about them because I've just shot them all." He then hung up.

Within five minutes, three police cars, an armed response unit, and an ambulance showed up at the Phillips residence. Of course, the police caught the burglars red-handed.

One of the policemen said to George, "I thought you said that you'd shot them!"

George replied, "I thought you said there was nobody available!"

    I see that you're right.

I think that the tough thing is to prove that they're not actually ill without having some sort of medical qualification and time to perform an examination.

Cannot believe they are thinking of going on strike / blue flu. Many of them have such an easy, doss life. One I know retired at 50 on big pension . All he did before that was look after his investment property + chat to people.

Well there's this female Gardai that I regularly place in handcuffs...

Here we go again with the anti Garda posts. Just for the record, there's not much anybody can do to a garda unless they want to suffer for it. If you try to arrest them, they'll just lob you off to jail yourself for attempting to harm a police officer, there really is no way a Garda can get properly arrested unless it's by another garda.

As for the question. Would I arrest a garda? Eh no, I don't care enough about what the gardai are doing to really be bothered trying to lock one up, or even risk ruining my night by doing some sort of holier than thou
Sh!t. I'd rather just stick to drug dealing and raping prostitutes thank you very much.

Right, best join the guards then. I'd love an easy, doss life.

Lets hope you're not just talking shit, I'd hate to have my new dream career ruined because it turns out you're waffling on about something you haven't got a clue about.

    That'd be awful....

They'd be breaking a law, so they could be arrested if it's a case that Marshall Law is brought in on any day which they decide to strike

It probably won't happen, but I'd lol if it did

And if they do strike, both civil & criminal charges can be brought to court against the Gardai

If someone breaks into your house you find the biggest heaviest thing to hit them with knock them out tie them up and then wait 60mins for the guards sure it normally takes them that long if they are called around my way.

"Joe, you went on strike. I have to arrest you"

"What are ya taking about Mick? So did you!

"I'll tell you what then Joe - you arrest me and I'll arrest you. We can take turns sitting in the cells"

Aye, I can see it happening alright, all the Gardi arresting themselves!

Martial law could lead to military dictatorship, which would be a bitch - worthy of at least five AH threads.
