For free? Hah NOWHERE! It is NOT FREE as advertised. Here is the thing:
I have bought a laptop form Currys, 2 weeks before W7 released. I'm an idiot though... I was told that the upgrade is free. I thought that I can download it since it is free. BUT the HP want to give my update "package" as they call it for 30 EUR! Lads, that is loads pints!

Well I want to start a consumer rights complaint, If anyone have the same problem let's meet on this forum, and cooperate against them. WE ARE ENTITLED TO GET IT FREE OF CHARGE, because they have failed to inform us about the costs!

Here is my mail and the response from Currys, I have replaced the names and few other information cos it's not relevant here. The HP given me similar rubbish.

Okay, if anyone think after reading that I have no right to what I want from them, please explain it to me, I am flexible and accept criticism. See my comments after the quotation as well:

    Dear Customer,

Thank you for your email dated XXth October 2009.

As the upgrade is provided by the manufacturer, we
advise that you contact HP and voice your concerns
regarding the post and packaging charges as we are
a 3rd party, not the manufacturer of the software.

I apologise that we are unable to assist you further with
    this matter.

    Kind regards,

    Dear CS,

Meanwhile I have already figured out who sets this hidden price. This
is not relevant at all at the moment. What is relevant though the fact
that I was NOT AWARE of this fact when buying (however I have searched
for it before buying on the internet as well e.g. the neither the HP
provides this!) so I had no chance to make the right decision and
postpone the purchase. This is due to the fact that you were NOT
PROVIDED THE CONSUMERS with the proper pricing information. Calling
something FREE which we have to PAY money for is called SCAM in my
    dictionary.

Therefore if you refuse to provide me with the update free of charge,
I will enforce it through the Small Claims Court.

I let you know, that I also submitted a written complaint to the
actual store manager in the XXXXXXXXXXXX, because I got
no response by yesterday via e-mail.

No answer to my question, why I got no information. NOBODY is responsible of course. But me, because I have no telepathic capabilities to figure out remotely what the heck they are doing..

Now, what do you think about the FREE upgrades? Okay If I would presume that the currys did not know about it either, but then they need to contact to the HP and arrange the legal stuff with them right? Why cannot they investigate this issue?

This is ridiculous that I have W7 licence already and someone prevents me from using it. What am I buying though? Licence or the windows 7 DVD? Since the HP laptop comes with NO CD or DVD , just a backup D: drive why are they insisting to send me the DVD for 30 EUR?????? For profit of course! Selling something which is free, and using the DVD as excuse for this horrible price.

If anyone have any further information about how can we get the upgrade free, please respond.

I have a good idea. We all got free licence to Windows7 right? Therefore it is not illegal to share the Upgrade DVDs via torrents or rapidshare. So all we need to do in order to undermine this scam:D, to share the DVDs for each manufacturer. Those DVDs won't work anyway if you don't have licence. Does anybody already ordered them?

I remember reading that Microsoft was pretty pissed off at some of the prices being charged and yet they haven't been able to do anything. If microsoft can't do anything what can currys do? I assume microsoft will enforce some maximum charge for the next upgrade.

    I doubt it pretty much.

    1. You are not able to use the upgrade package properly if you don't have a qualifying PC and Vista licence key. In other words, If I install the upgrade what I have downloaded via torrent, it will be legal copy anyway, because I already have the LICENCE, and even the WGA will detect it as legitimate copy! I already paid for that when I bought my PC with a qualifying Vista.

    2. Is it illegal to ask a friend of mine who already got the CD to borrow it to me for a day or two? Or even pay 15 EUR for my friend and half the price between us that way?

    3. I think the M$ is already aware that it is unavoidable that the binaries does not go to RS or torrent. That's why they are pushing licence key verification.

    4. I have found an article which says, it is also legal to use the UPGRADE package to install the W7 from scratch (cos your vista died in your attempts or you had XP etc...). If you have the license key of a qualifying product (XP or Vista) The result will be legitimate. If you get the proper version of the W7 at the end what you aready have licence for, it is all legal, and all technical workaround is okay.

Of course the risk what you take if you choose alternative sources is you may get altered upgrade package, with a trojan preinstalled....

MY CLAIM is: Why they have missed to display this hidden charge? The only thing they had to do is enter the serial of the displayed laptop at the webshop of HP, and display something like this:

    "
    HP XXXX laptop XXX EUR
*With discounted upgrade to Windows 7 cost additional 30 EUR
    "

That's all I wanted to see in the shop!

Stop doubting it. The content of the DVD/CD is covered by copyright distinct and separate to the licence.

And even if it wasn't (which is is), boards doesn't facilitate what you're hoping it to facilitate.

I agree that 30 euros is taking the proverbial, though it's worth noting that the charge hasn't increased much (if at all) for such a P&P-only upgrade in over a decade.

You would not have a license for it

and the upgrade is probably locked to Dell BIOS so probably won't install

You are right. Even my HP has a fancy restore/upgrade system which is HP specific, and it is not good for any other machine. You need a dell set, or you will face installation issues.

Meanwhile I have figured out, that a new sticker will arrive with my "free" serial number LOL. Smart fellas eh? (At least they think they are...)

And yes, I'm a kind of bored from those companies who think custmers are brainless sheeps. This was the FIRST AND LAST time they could manage to trick me like this. Okay okay I stop it right now - this forum is rather supposed to be technical than a kind of consumer law complaints type.

    Good luck to everyone!

The 'FREE Windows 7 Upgrade' is quite a scam.

I have two clients who purchased HP machines only to find out that their 'upgrade' deal is not all it is advertised as.

First, one customer with a new laptop found out that it costs €30 for shipping. Thats right - €30 to ship you a DVD in a paper envelope. The cost in the shops is €60, so at best we are talking half price.

But thats not the kicker. We sent off his receipt and paid the €30 online, only to get an email a month later saying they need th receipt. We told them we posted it, per their request. They said they never got it, and canceled the order. No upgrade for him, and they haven't refunded his €30 either. There is no complaint area on their website and no contact info. If you email or ring support they tell you they only deal with technical issues and we have to ring customer service. Customer service tells us that its an outside group handling this upgrade, so they have no power over this and to contact them. Wow, two days on the phone to find out HP has nothing to do with their own upgrade offer.

Then there is another client of mine, who also bought a new HP desktop PC. The 'upgrade advisor' system tells him his serial number is invalid. HP has confirmed the number is valid. We even registered the product on their website. We can pull up the product specs and warranty info from the serial. But the upgrade advisor says its not a valid number. We contacted the third party handling the upgrades and we told it was a valid number and they had no idea why their system wouldn't accept it, but they would investigate. They promised within 10 days they would have it sorted. That was 16 working days ago, back in January. They no no longer return our emails.

All I can say is don't buy a HP machine. Their customer service is quite possibly the worst in the world. A quick Google found that I was not alone and others had the same opinion.

Hi. here is my take on some of the issues posted here.
Your free windows 7 upgrade is essentially the licence key for windows 7 software. this does not include the actual software hence the completely misleading extra charge for obtaining the software itself. (licence key for windows 7 home premium etc only valid for home premium, not ultimate etc).
Windows 7 will cease to work correctly after 30days unless u have valid licence key for your version of windows 7. microsoft has consistently stated that windows 7 versions installed on computers are perfectly ok as long as there is a valid licence key, whether the windows 7 was installed numerous times on numerous computers from the same source cd. the same goes with office 2007 for example. you can legally download 100% working office 2007 (home, professional etc) from microsoft as a 'trial', but within the timeframe u must validate with valid licence key to use after timeframe. microsoft in reporting sales/profits will not state that office 2007 dvd has been sold xxxx million times, it will say xxxx office 2007 licences sold. same as windows 7.
the bios of your computer will include preactivation for windows sold with your pc. bios version will be 2.1. older laptops with windows vista will have bios 2.0 and will not be able to preactivate windows 7. so installing upgrade windows 7 sold to dell laptop user should be activateable on another brand computer. with valid licence key of course.
In short, those that have received free upgrade to windows 7 but have not got the actual software dvd and dont want to pay 30euros for it, can install the correct version of windows 7 on their computer from whatever source they wish, as long as they have 100% legal valid licence key for their version of windows 7

In short you have to pay to get a legal serial number AND the COA sticker.
