If you had the power to make/repeal one law, what would it be?

I would get rid of the double jeopardy rule.

It really bothers me that people can appeal a conviction, but the State can't appeal an acquittal. Obviously I would still put some limitations on it, such as there has to be new evidence, or the acquittal would be on a technicality or something.

    Anyone else have any ideas?

P.S. I also posted this in Legal Discussion, but the answers in AH tend to be much more "colourful"!

Not technically a law, but as it is supported by legislation my vote would be for VRT.

Reasonable laws off the top of my head (except maybe the 2nd).

24/7 drinking licenses/opening hours (more for the opening hours than the drink).

    Legalise certain drugs.

Just as well you didn't. That's not what double jeopardy is and the prosecution can appeal an acquittal in certain circumstances.

I would introduce a new limit of 100mph on our Motorways and 85mph everywhere else, abolish the metric system and abolish the liberal media who are brainwashing our children and promoting egalitarianism.

Make the law be on the side of the victim ,not the criminal and life in prison should mean life in prison .

There is a very strong possibility that I completely made this up in my own head BUT I thought the state could re prosecute for murder if they have new evidence?

  • Closed Accounts Posts: 243 ✭✭HarryPalmer

    Legalize abortion.

My God, I forgot that was still illegal here. Pathetic.

I would make a law that requires Kate Beckinsale to be my sex slave.

I also thought once sombody's acquitted of murder they cannot be re-tried for same offence ,even if outstanding evidence is discovered although not 100% sure ?

  • Closed Accounts Posts: 243 ✭✭HarryPalmer

I always thought that double jeopardy was final, save for the case of hung jury where the legal process has demonstrably failed. I'm pretty sure that if I look through my old university law books, it will say that you cannot be tried twice for the same crime irregardless of new evidence. It would be a mess of a system if a man could be.

Might be wrong though. Blame the publican for serving me.

    New Laws:

1- There shall be no more than one government finance budget in any 12 month period.

2- Nobody should earn over €150,000 per annum.

3- Criminals must serve their full sentence + a futher 2 years (for sentences over 10 years), 1 year (for sentences between 5 and 10 years) 6 months ( for sentences between 1 and 5 years), 2 months (for sentences up to 1 year). The additional term can be scrapped on good behaviour to be approved by the serving minister for justice.

    4- Abortion allowed.

5- Tribunals that cost millions to discover what politicians do with 10k "donations" to be abolished.

1 - How to react to changes? Sure, we gave most up for the Euro, but don't we need some flexibility?

2 - Why not? My boss earns way more, but also created a couple of hundred jobs, including mine. Why should he not enjoy some money? He worked hard, and through a mixture of that and good luck did well. Fair play to the man.

Declare marshall law on skangers - allowed to gang up on them and beat lumps out of them - the known skangers/dealers/joy riders in a neighborhood for expample! :D

I still stand by this, we need to see whats ahead. Last budget the government increased the dole by 7 euros per week. It now looks like it could be scrapped. I think people need to know whats happening.

Well number 2 I failed to explain. Maybe I should limit that one to public sector workers and bank executives. My reasoning is that alot of people in RTE for example get paid way over the top to do jobs others would love to do for small money. Lets say.......offer Pat Kenny €150000 for his next contract........take it or leave it Pat.

N1 - What I was thinking would only work with a competent government. Point taken.
    N2 - Agreed

Make it legal to physically assault anyone on public transport who is being anti-social eg smoking, drinking beer (in a non-quiet way), feet on benches, feet strewn across the aisle or broadcasting music from their phone etc.

Anyone who proposes the introduction of capitol punishment must also provide a system for dealing with cases of wrongful conviction. Anyone who then cannot find a way to reverse death is banned from expressing an opinion, ever.

anyone who commits a crime while intoxicated should have their sentence increased for being a fkn idiot instead of being allowed to claim diminished responsibility.

crawling out of woodwork or indeed any type of beetle impersonation should get a mandatory 5 year sentence.
