Drunk Driver

Last night my dad was working ( hes a taxi driver) and a drunk driver in his mid 20's crashed straight into the back of him (the dent in the back of the car looks really bad). There was 4 passengers in the taxi and one old woman in her late 70's. She was in great shock but luckily nobody was hurt including my dad. My dad rang the gards and they quicky found out the other driver was drunk (6~ pints) and he had no insurance. The drunk driver was arrested and taken back to the station.

Now here comes the dilemma. Seeing as the drunk driver was uninsured will my dad have to claim off his own insurance?

I don't know a great deal about how the crash happened or how fast the drunk driver was going because my dad is in bed and he only got to sleep by drowning his misery ironically on the drink. He's in great shock according to my mom.

This really ****s my dad up now because he could be out of work for a while with no income coming in and trying to support 2 children and an unemployed wife because some idiot of a drunk driver thought he'd take the risk. Well I hope he burns in hell.

I think there is a fund set up by the insurance companies in cases of drivers without insurance or hit and runs.

IIRC, they all pay so much into it each year and that covers these incidents.

And it also takes forever to get a payout from the same fund IIRC.

Real sorry to hear about that OP. Talk about a ****ing disaster for your Dad.

OP your dad should see a solicitor and seek advice from them.

He shouldn't rely on his insurance company as they'll always take the easy route.

Is he a member of a taxi union?. Maybe they can point him in the right direction also.

Either way, he'll be claiming from The Motor Insurance Bureau of Ireland I'd imagine.

I hope your Dad makes a speedy recovery.

I'd also think a solicitor would probably be the right way to go. Is the car completely out of action?

Yeah. Its not a simple fill in form and they pop out to see what happen. Their solicter talks to your solicter, then they go to court and argue the settlement.

Can take awhile but thats looking from a hit and run incident.

I don't know how its dealt with in these cases.

For all i know, the insurance company may cover him and seek the costs from the fund.

OP spook_ie (a member here) has a taxi forum over on dublintaxi.ie (its actually a national drivers forum).

You might get some insight from the lads over there.

Either way, it wasn't a very nice thing to say to a young lad worrying about his Dad who was injured while out working, providing for a family.

No doubt it'll be a tight Christmas in that house hold, but I get the impression that just because your jaundiced by your own negligent actions that you won't give a flying fvck.

I have had to claim off the MIBI when a stolen car ran into the side of my parked car.

It really wasn't that big a deal. Worst part was trying to get the lazy bitch of a cop to submit her report for me.

Yea there is some taxi drivers like that, my dad even talks to me about them but does that mean hes like one of them? My dad is really bad mentally, hes in total shock, he's never had a crash this bad before in his whole 40 years of driving and 12 years of driving his taxi.

I'll show him this thread when he wakes up if he feels up to it which I seriously doubt. Thanks for the information to everyone else anyway.

Don't react to that poster reasonably, he didn't when he read your original post. All he saw was that a taxi driver was injured and was too busy busting out the champagne to give your post more than a cursory glance and realise that it actually wasn't your Dad's fault. According to him, taxi drivers are bad and that's the end of it.

OP is your Dad comp insured? He might be OK to get the car sorted out then by his own insurance.

I was hit by and truck a couple of years back that kept going. There was a few grands worth of damage done to my car and it was sorted but I then found out later on that instead of claiming from the fund (this applies when you dont have comp apparently) there is another insurance fund that they use for such matters. Worked out for me as I did not lose my no claims and was also able to continue with no claims protection as well. Make sure he follows up as they might try to get out of this (as another poster said the union should be able to help out)

Sorry for you and his troubles but thankfully everyone is OK

The MIBI (motor insurance board of ireland) deal with uninsured and unknown vehicles. Your dad just has to go thrrough his insurance and they'll deal with the MIBI my friend had this problem before and she got her compensation fairly promptly. Goodluck and I hope your dad recovers quickly

Pay someone to break his legs. No excuse for driving uninsured.
    ****ing scum.
Some of the best people I have met in foreign climes have been taxi drivers. Tend to be a font of local knowledge. Love hearing how exciting they can make an entire life story and yet fit it all into ten to twenty minutes.

As said above MIB will sort it out.

Which of course is funded by insured drivers.

If out of work then he will need to show his returns from previous years. Some taxi drivers will be in trouble if that happened to them

and this comes from where ?
the taxi insurance companies have a set rate that is payed out for loss of earnings .last time i checked with i think it was axa the rate was
80e a day up to a max of five days .
dont know where you got that information on having to show tax returns to make a loss of earnings claim to you car insurance company .

Don't dwell on what that Darren guy posted, no one else has.

The likes of him and his ilk come here, post up some total crap for a while - realise they're misfits in the company of (mostly) good people and feck off elsewhere.

If your Dad is still shook up, suggest getting out of the house for a walk with you. Get his mind off the accident, and show him your not too upset either.

I'm a father too, and I think in your Dads case I'd be more worried the effects of this are having on my family moreso than I.

Post over on Spooks board, the lads there seem fairly level headed.
