Bought faulty item from Ebay - Now What?

    I bought a used Pioneer head unit for my car from a seller from Ebay. Very nice guy, happy with service etc, got the item in mint condition, as if it had never been used, all original packaging etc. However I got it fitted and everything wroks fine except when I put a cd in the eject button will not work. I'm not sure if this happened since I have had it, or perhaps he was just trying his luck.

    Is this a case of Caveat Emptor? Will I just have to deal with it myself and get it repaired, or is there anything to say that I can return it and get a refund because it does not work as advertised?

    You could try to be nice alright and hopefully he might replace it but realistically you don't have a leg to stand on unless you possibly sue him which more than likely won't get you anywhere.

    Where is the guy located? Is he a business or a private individual?

    If he operates a business then you have a possibility of recourse as you could contact the European Consumer Centre. If he is just an individual then Caveat Emptor applies.

    He's just a private seller - 100% positive feedback form 57 buyers. Very helpfull and nice guy to deal with. i'll try ebing nice and perhaps ask him to foot the bill for the repair.

    Difficult one as it is possible that the fault occured during the installation (or the seller could say it did!). I would ask the guy where he got the unit and when. This will allow you to contact Pioneer direct to see if they can fix it under warranty.

    I doubt the seller will pay towards a repair.

    Have you requested the seller's contact info and given him a telephone call?

    Did you pay by PayPal?

    If so, you can file a dispute with them, if not you can file an Item Not as Described dispute with eBay.

    Yes I payed by paypal and have written him 2 emails and recieved no responce.
    What should I do now?

    Have you left feedback? If not threaten him with bad feedback if he doesn't respond in a certin time. If not there's not much you can do but see if it's still under warranty.

    You can ring PayPal. Their number is 1890 943 220.

    You may still be able to file a dispute with the seller through PayPal. The PayPal help pages have info on this under "Protection Policies".
