    Hmm this is a grey area. Maybe they are both? A cake-biscuit if you will. I'd go for little cakes though. Its the sponge.

    A. No, no the're not. Apart from being called cakes they obviously have a sponge base. Granted they appear to be some kind of luxury biscuit being chocolate covered and shipping in a box.

    Definitely biscuits... ..someone should get onto the standards in advertising people and make them stop! ..I would but I'm too busy stuffing the biscuits into my mouth.

    But the sponge bottom, on the real ones anyway not like the fake ones with hard bottoms, are cakes!

    whats the best way to eat them , i go for sponge first, then chocolate toppping followed by the smashing orangy bit!

    i once ate a packet like this and kept ALL the orangy bits till then end! mmmmm tangy!

    In the UK Jaffa Cakes are legally cakes according to the VAT man. The rates of VAT for biscuits and cakes are different. So Jaffa cakes in the UK attract the lower VAT rate and are therefore excellent value for money. Yum yum :p

    As far as the tax man is concerned they are cakes.

    I think the vast majority of people consider them to be biscuits!

    I'll go with cakes simply because of the spongy goodness.

    How do you eat yours?
    First I bite a chink out of it getting just a taste of the gooey centre.
    I nibble the chocolate around the edges leaving just the orangy bit and the sponge.
    Then I gobble it up whole. Hmmm, I want one.

    who cares whether they're cakes or biscuits, they're YUCK!

    i seem to be the only one who doesn't like them
    although i admit i will eat them when i have the munchies and need a sugary fix.

    many a time has a box of jaffa cakes brought a stoned ferdi to his knees, especially as they always seem to be on spacial offer in the centra in ucd, which convinces my feeble mind that its a good idea to buy them...although the mc vities ones are ****e.

    They're biscuits.
    Why?
    Because you can eat a lot of them and still be hungry.
    If they were cakes you'd only need to eat one.
    That's a simple rule. If you have to eat more than one, then it's a biscuit. Just one, then it's a cake!

    Problem solved. Next Cake Pie question please.

    Fancy biscuits I think, because of their dimunitive side. Having said that at what size is a cake not a cake? What about a cup cake? Where do we draw the line people!!! confused.gif

    OK, i'm gonna try and settle this up now...

    Was watching QI the other night on BBC2 and this exact same discussion with Jaffa Cakes came up during it.

    Stephen Fry then told us that..

    The matter was settled over ten years ago by a VAT tribunal in a very expensive case. McVities argued that they were indeed cakes (and hence zero-rated for VAT), while HM Customs and Excise argued that they were biscuits and hence subject to 17.5 per cent VAT.

    McVities even baked a cake-sized Jaffa Cake for the tribunal chairman to support their legal arguments.

    McVities won the case, primarily because of this fact (wait for it!)...

    Biscuits are hard when fresh, and soft when stale. Whereas cakes are soft when fresh, and hard when stale. Jaffa Cakes, of course, fall into the latter category.

    There's a nice little fact for you there!

    yep due to the moisture content they are deemed cakes as I discovered today in converstation with a revenue related person.
