Removing name from title.

    Two Situations:

    (1) - A person and their widowed parent were joint owners of the family home. It was registered in both names.
    The parent passes away. The person instructs their solicitor about getting the house registered in their own name. This process took about 6 weeks to complete and cost a few hundred euro.

    (2) - A couple and their teenage child were joint registered owners of the family home. One of the couple died and the survivor instructed their solicitor (different to above) to remove the deceased's name from the deeds, leaving them and the child as registered owners. A similar situation to (1) except that almost 10 months have passed since instructing the solicitor and the process is nowhere near being completed.

    No other family member has an interest in these situations.

    What do ye think the reason might for situation (2) to be taking so long to complete?

    Is the second one a Registry of Deeds case requiring a first registration at the Land Registry? Was the first case joint tenants and the second tenants in common?

    There's a reason why you tend not to put minors (persons under 18) on title. It complicates future dealings hugely.

    The second case could be more complicated and there's also very little processing taking place in the Property Registration Authority atm.
