Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Can I sue my Elderly Uncle?

    I was over at his house and he was after washing the floor. He didnt have a wet sign up or didn't tell me and I slipped and now have a slipped disc.

    He invited me into the kitchen without telling me or without a sign present.

    What are my options here. I want compensation from him, maybe 150K for my medical bills and suffering.

    You can sue anyone. Doesn't mean you'll win though.

    This being Ireland, you'll likely get €20k though.

    I guess he could counter sue for reckless endangerment due to visiting his house illegally during a Level 5 lockdown.

    Also you may have damaged his expensive floor. Then there’s the psychological damage.

    he may under threat arrive at your place to agree a settlement and trip on way in and counter sue.
    being elderly the courts may favour him and attack you.

    To me .... this is an open and shut case.

    I’d take him to the cleaners and go for €500k. People shouldn’t be washing floors when they have visitors..... sure it’s written in the Constitution.

    Ps.... keep an eye of for any friends or neighbours buying mops and buckets etc and be sure to call around unexpectky . You have rights you know to walk where you like. Power to the People

  • Takes me back, when I was in school it rained and someone unfortunately slipped in the car park.

    Post incident, someone on the student council made a serious suggestion to put a wet floor sign in the car park.

    The whole insurance claim is a farce, whether slipping on a chip, falling in a pot hole or getting hit by a car travelling 4mph

    not so , if someone you believe is negligent decides to act beligerently when it comes to a public liability insurance , its not easy at all getting money off them and they are not even obliged to be insured in the first place

    different story with motor insurance claims where bar unless you are a tinker , the law will force you to step up and be accountable for someones injury

    At the risk of associating myself with such a comment, given our courts propensity to hand out cash for dodgy claims, its a pretty safe to say, personal injuries and compo culture is a farce, whether you've the comfort of insurance or not. Indeed there's a lot to be said for defendants being far more belligerent and counter suing, if the odds weren't stacked against them.
