yeah, they weren’t allowed argue the constitutional rights aspect of the case. however, that doesn’t mean there’s an absolute rule against it re unincorporated associations (companies is slightly different again i think). SPUC v Grogan (had objects clause re unborn) and Irish Penal Reform Trust (had legitimate interest in prison conditions) are the two main citable exceptions. however, it seems to be a very high bar to meet. I’d imagine the fact that the right to a healthy environment wasn’t recognised impacted upon their ability to show locus standi but realistically there’s no clear cut rule (like everything else in bloody constitutional it seems).

What do people do if they forget the name/year of an Act? Is it ok to just write the name of the act without the year or does that look bad?

Personally I'd think it is better to name it than nothing. Obviously only if you forget otherwise include section and the year. Otherwise it could highlight a gap in your studies.

I studied before and then when there was a min left until the exam start I just put my notes away, I also went to the bathroom 3 times in one exam and it was fine, don’t stress about that too much it’s honestly not a big deal I had no issues with it

A kind soul shared their exam script from November a while back on here and for one of the questions, they had the year of a few of the acts wrong. The examiner circled the mistake throughout but they still managed to get a really decent mark for the answer so I wouldn’t panic

Same here, still waiting. I emailed them just there and got an automated reply saying that if I've queries to go to the page you can register, which isn't the most helpful, but I'll give it a maybe an hour or so

Hey, if you go a few pages back there was a few posts and links on this that should clear up your confusion.

Basically, there are 2 recent Supreme court decisions involving "Friends of the Irish Environment" from what I gather, the one involving bord pleannala isn't really relevant for Constitutional, it's the one vs Ireland is relevant as CJ Clarke goes through standing, derived rights etc.

Just with regards questions about plans and the sticky notes, would not recommend writing your rough plan in the sticky notes. I had a whole plan typed up basically an outline of my essay in the last round and somehow managed to delete the whole thing and had to waste time writing it out again. Don't think there is any harm typing rough plan in the answer box

My first exam is Company so awhile away yet but my exams aren't up on Better Examinations either. Hopefully they'll have them up some time today!

Totally agree. I typed out my rough plan under a "Rough Plan" heading and then started my answer underneath under "Answer" heading like I would in the written exam. I didn't use sticky notes or anything as found them annoying.

i think purpose trusts is quite an important topic tbh. i know they came up in november but theyve been recommended by the night before notes and the lectures i used really emphasised them. only thing is you need to know all charitable purpose, cy-pres and non-charitable to answer a Q on it!

Hi all, just re the exams - I would suggest doing rough work in the answer box and flesh out in your answer the cases, acts etc. I used the sticky notepad in my exam in November 2020 and all my rough work got deleted. I’m not sure if this has happened to anyone else but just thought I would let you know.

I would recommend covering this as it comes up as a note sometimes and I think it can be mixed in with the charitable trusts problem q. I know what you mean about the unincorporated associations being confusing but I literally have 2 cases on this part and just a couple of points which should be enough for a general note Q or if its mixed in with a problem question on charitable trusts.

Is there anything I’m leaving out or any specific case law I could refer to?

for remedies i found the following useful: TD v minister for education (demonstrates the reluctance of courts to grant mandatory orders), Blascoad Mor (entitled to recover damages where damage is proved to stem directly from effects of the invalidity), Conway v INTO (talks about why different damages would be awarded - ordinary damages for physical injury mental distress etc, aggravated damages due to the way the wrong was committed and punitive damages intended to punish the defendant rather than compensate the pf)

In Hand the issue was that the applicant had been convicted of unlawful casual street trading and his license had been revoked. He argued this breached his right to earn a livelihood rather than property rights and the court held that the oireachtas was entitled to restrict the right to earn where this is a proportionate restriction in the common good. I did the City course and the lecturer mentioned that in the last exam people didn’t notice that the license in a problem q was a property right and that the examiner was critical of that so I’d definitely keep Muldoon in mind

I thought the hand case just clarified that the right to livelihood can be restricted in the common good

Hempenstall also stated a license is a property right

for my notes on non charitable purpose trusts I literally have a few points on the policy reasons against enforcing them and like 2 cases there then a few points and 2/3 cases each for the 3 exceptions. I think (hope) this should be enough as I've only seen it come up as a note on its own or mixed in with a problem. has anyone ever seen it come up in any other way? Would love an opinion on whether people feel this is enough detail

i left it out but wondering if i should cover it as well. I left out all the houses of the oireachtas as it came up last time. anyone any advice on whether we should cover privilege and confidentiality only ? would it come up as part of problem question maybe ?

I think Kerins could come up as a case note rather than a full question this time simply because of its significance. That’s just my opinion and I could be completely wrong but the city lecturer said not to leave it out if you can.
