Path upkeep on a right of way

    Who (if anyone) is responsible for the upkeep of a path on a right of way used by the public? There's a path near me which has become heavily used during the pandemic by walkers & cyclists, and as a consequence it's very eroded.

    It's hardly the landowners fault this has happened and would seem a bit unfair if they had to maintain it, but on the other hand it seems to defeat the purpose of a right of way if it is impassable. Can a community group offer to repair it, and who would they be making that offer to?

    You could always set up a resident's association.

    The council will then;

    provide training in Committee Skills
    help your group to develop programmes of action.
    provide information on funding.
    arrange for your residents association to meet with Council Officials and Public Representatives to discuss issues in your area.
