Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Child maintenance over 18

Re-posting here as it may be the more appropriate forum.

Would appreciate any information/pointers in the right direction.

The 19 year old, who lives with his mum, has dropped out of college. I know there is no legal obligation to continue with child maintenance payments once he is over 18 and no longer in full time education.

I've just seen something ('legal' website) that suggests that once a child is 18, the maintenance payments can be made directly to the child.

I'm just curious, is it correct that the money can be paid directly to the child once over 18? Presumably if we did this, his mum would charge rent etc. but that's not the issue.

    Thanks!

You kind of answered your own question to be honest.

You don't need to provide maintenance anymore, if you want to give an 18 year old money, that's up to you but it may be subject to tax if you go beyond the yearly gift allowance.

Thanks for the response killanena - you're right - I phrased it badly. I guess my question is if he hadn't dropped out of college could the money be paid to him directly or does it legally have to go to him mum until the age of 23

Is this a court order maintenance payment? If so I'd assume it would still have to go to the mother. It seems specifically linked to the other guardian.

Aha, I can't help you there I'm afraid but I would think it would be a bit ridiculous having to pay maintenance for an adult?

Sorry, closing thread as you sought legal advice which is not allowed by the forum charter
The solicitor who acted for you in the original family law proceedings or their successor may be able to help
Apart from that thanks for posting here
