Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Bank negligence

    Hi,

I am looking for a advice. My mother in law signed up policy in one of the Irish bank to protect her in a case of sickness or loosing job. It was 6 years ago and we have a letter proving it.

Recently, she found out that the policy never started due to the Bank negligence. They sent her letter admiting it was their mistake and the cheque of amount 500.
We are thinking to go against the bank.
Can that be a strong case?

Was there actual damage to her from it or do you consider action just because?

So to clarify.. your mother didn't get a policy document, didn't receive yearly updates, and didn't pay any premiums?

Can what be a strong case? There is no case unless she has suffered a loss, but you haven't mentioned any?

Did she fall sick or lose her job?

It is up to the insured to ensure that the policy is in place and the premium is being paid. It looks like your mother did nothing after signing the form.

If she has suffered a loss because of this then perhaps - as in she lost her job her has been ill and now when she needs the protection of the policy it is not there.
Although it is the banks mistake in 6 years she didn't pay any premiums nor bring it to their attention
so she herself has been somewhat negligent.

If it is simply error that the policy never came into effect and she is not claiming against it then I'm surprised she's getting 500€ to be honest.
