Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

planning observation fee not returned by council.

    Recently a planning application was submitted to the local council. A number of people submitted observations (@ €20 per observation) concerning the application. The application was withdrawn. No refund of these observation fees was allowed. Does the planning applicant get his planning fee returned by the council in a case like this?

    I can't see why fees should be refunded as a fair amount of work probably took place on the planning application by the council before it was withdrawn and probably due to the opposition to the planning, it got withdrawn.

    In some cases the council will advise that the planning has no chance of success due to items brought up in the observations and the applicant then withdraws it rather than go to cost of getting extra studies done.

    Take it as €20 well spent

    Applicant doesn't get fees already spent refunded.

    The applicant only gets their fees refunded if the application is invalidated. In the case of it being withdrawn it is most liokely that the council were going to refuse the application so the applicant withdrew it rather than have a refusal on their site.
