    this could be long so bear with me, my dad sold a site on farm about 40 years ago, family built a house. The father always walked our fields with his dog never caused a problem, left gates as they where, would bring kids along too sometimes. He just climbed through wire fence from his boundary on to our land. About 15 years ago my dad sold a site to his daughter adjoining the other site. When this was being fenced off they used post and rail and left a little gate onto our land-they never asked could they do this- Anyway the father continued to walk our land using this gate always closing it after him.The daughter and her family would go up the fields sometimes too. In the last year he has become ill, the gate has been left open , cows got in to the garden last year- this was a big laugh to the son in law, who said he would make sure the gate was always closed. So twice this year cows have gone to go to paddock beside their house and the gate was open when i checked before i let them in. Can i block off the gate? I am assuming after all these years they have a right of way, In my mind i shouldnt have to go and check if their gate is closed before letting my cows in to paddock

    I thought you could only have a right of way to access your own property? Which these people are not doing.
    Exiting your own land/property to wander over another's, for a casual walk or whatever, would not create a Right of Way. In my opinion.
    The other concern, would be that you might be found negligent if one of these walkers fell or injured themselves on your property. By allowing them have a gateway into your field could be considered giving your consent to their presence in your field.
    If you are happy to let them walk on your field, however, perhaps arrange/ask them to fit two of those coil springs you see on doors sometimes?

    just maybe call around to them and ask is it ok to put a chain and lock on the small gate and offer them one key and you keep one?

    otherwise 2 strands of wire right to the back of the gate, off the mains fencer

    initially there was one of those spring coil thingys on it, i would know the people all my life and in the last year i really have bitten my tongue, they would let the father head of up the fields on his own- he has been very ill- I said it to the son in law and his reply was he loves going up those fields, i am afraid of him falling or some thing.Escpecially when bull is with cows. I went to the mother last year and she sorted it for a while. Thats not an issue any more as he cant go out . But anything i raise with them is met with a laugh or a joke.

    Well, then they will laugh and joke when you put a chain and a lock on it. Permanently.
    There's a fellow near us, always ready with a laugh and a joke. Fundraiser in the local community etc, always ready to take part in a skit or on stage.
    Collided with a ewe on a back road a couple of years ago, car superficially damaged. Sued for whiplash, and took 80,000 Euro from the owners of the ewe, two bachelors in their 70's.
    hHs since built a very nice extension to his house, etc.

    all rights of ways now have to be registered, if not registered you have every right to block it up

    Thought this myself. That surly wouldn't count as a right if way as it's not into any property of theirs

    yup, parents had to take the coco to court when they tried to establish a right of way over our ground.

    OH sold a site on a out farm a few years ago. There is a well on his land near the new house and the people asked could they run a connection from it for their garden etc. No prob says OH as long as you pay for it etc.
    Anyway when they were putting up the post and rail fence around the house they left a gateway near the well. OH asked why they did so and they said so they could have access to the well. OH asked them to remove the gate and they did not. We put up 3 strands of barbed wire fence on our side of the post and rail fence to prevent access. Solicitor advised us to do this and take a photograph every year.

    Yea but as OH said when I showed, why couldn't the first car overtake.
    We've witnessed loads of times where a car will just sit waiting for the tractor pulls in to a standing stop before passing

    There's more places to overtake than pull in on that road. I don't believe the 7k tailback. Story a few years old now.

    Probably a ****ing Yaris driver anyone who drives one of them has no shame.
    Nearly always the first car in the que is a yaris

    I agree...
    Sometimes when I'm out on the road I listen to audio books on my phone.. And we've no TV at home, 2-3 days with no news at all is a great break !

    I agree. People get so wrapped up in it. And feed on the negativity. Yes it's terrible for the people involved, but no point worrying about every little thing that happens, the reality is that there is terrible stuff going on the whole time that we know nothing about!

    Well I have some good news for ye. I had a son born in the last few days. Mother and baby doing great. Bringing them home from hospital tomorrow :):)

    And nobody better start pissing on my bonfire talking about night feeds and no sleep and all the negative crap, cos I don't wana here it!! :rolleyes: They're all healthy. Crying, dirty nappies and lack of sleep.... bring it on, nobody died from it yet or at least I must have missed the news that night when that story broke!!
