House Purchase - part of original title deeds missing

    Hi All

    I'm considering purchasing my first property and have found a place I like. Unfortunately there are 2 pages missing from the original title deeds. A previous party tried to purchase the property and obviously this came up - the sellers solicitor provided certified copies [of the missing pages] from the register of deeds, but they still weren't happy with this and pulled out. What I'm wondering is:

    1. Will the title deeds be "reissued" when I purchase the property, and therefore the problem will be gone ? Or will those pages always be missing for the lifetime of the property and therefore a perspective buyer (ie me) could have problems selling the property because this would come up again in the future ?

    2. Is this something a lender (bank) would be concerned about, or given that the certified copies have been provided, would the bank generally be happy with this ? Or is it more complex than that ?

    3. Does the content of the 2 pages (ie, which pages) are missing have any relevance/bearing on how serious this would be considered ?

    Have you spoken to the Land Registry? They would be the people to ask for the copies.

    I would also take advice from your solicitor.

    Your solicitor will have to give the bank a certificate of title, if he or she is not happy to do so you have your answer. With the market as it is people can be picky and only buy houses with perfect title.

    Sounds like it's more of a problem for the vendor than for you. If they are having difficulty selling it then they should get the property registered with the land registry. If the registry is satisfied with the situation then they (the state) will guarantee the title and purchasers wont have to worry about it.

    Unfortunately large back log at moment!
