Hence the MS forum guys accusing me of theft.

    Sorry? MS forum guys? link?

As to the Market place theft banwave - these are all gamertag bans - not console bans.

Following is the letter I intend to sent to MS I would appreciate you guys looking over it and advising me on any changes.

For the MS supporters out there don't advise the obvious this is going to happen one way or the other.

I also want to copy this to the papers is this advisable? what do you's think?
    Dear Stephen/Harry,

I am writing this open formal letter of complaint to due to following actions taken by Microsoft.

You have blocked my console from connecting to a service I am paying for claiming the console is in breech of terms and conditions, I can confirm I am not aware of any breech of the terms and Microsoft denial of my right to defence is in breech of Irish consumer law.

If there is a fault with the console causing it to break the terms it most have been there since manufacture as there has not been any tampering on my end.

Every bit of content on both the consoles I own has been fully paid for.

Microsofts failure to treat me in a fair manor has lead to anxeity and worry as to what it is I could have done to break the terms and conditions

Further more in my efforts to find a cause for this problem on both microsofts own forums and xbox forums I found myself been labelled a cheater and a thief.

I have seven plus years of good service from microsoft, and did not expect to be treated in this way.

This is what I want as a solution to the above issues.

    1. I want the circumstance of the blocking of my console reinvestigated and a reason for the blocking of it, this does not have to be in great detail just this is what went wrong or you did this....
    2. If my console is found not to be in breech of the terms in want the following,
    3. I want the blockage lifted immediately.
    4. I want compensation for loss of access to xbox live network.
    5. I want an apology for the wrongful blocking of the console.
    6. I want a notice posted that I did not break any of the rules or terms of xbox live.

If I do not receive a reply within seven days I will enact the legal advice I have received

I am sorry it has come to this but your customer support straight out ban on discussing this problem with its customers as left me no other action.

    Regards

I just hope you or your son didn't participate in any wrong doing without knowing, not sure what that could be though as most things would be a GT ban and not a console ban

Looks fine. Just two points: use breach instead of breech and manner instead of manor, as those words have different meanings from what you intend, but otherwise OK. I would give full details of your xbox, and gamertags etc to help them with their investigations.

As for your points, I think 4 and six are long shots but there is nothing lost by trying and if it doesn't get a response I would certainly try the legal route.

    Best of luck.

I think correcting the grammar and spelling might have helped.

    North,

The letter's fine but if you don't get a reply in the next couple of days, send me a PM, I'll draft an alternative letter for you.

I genuinely believe you haven't knowingly committed anything to justify the ban, I stress knowingly. I would be glad to offer my help to resolve this matter, regardless of the outcome.

I think it's in the interest of all the forum members to know the reason behind this ban. So let's stop focusing on whether you or your son are guilty or not and start working together to get to the bottom of why the console was banned.

I know I do suffer from dyslexia and similar sounding words as well as b's and d's are a problem for me I usually see them after they are sent.......that said I have been dealing with this and my own work since 6 am this morning...

North1, I am unsure that xbox360achievements.org is an official site. Can anyone confirm?

Best of luck at getting to the bottom of it however.

I really don't think it is, no way would a company like MS let "mods" treat customers like that, atleast not on a forum for all to see. I already posted what I thought of the so called mods on that site, won't bother repeating it

    Hello there!

    This is an automated reply.

Don't you hate those? I do as well, but as you can imagine I receive an enormous amount of email each day. Therefore, I can’t personally respond to each one. While you may not get a response, I do try and read all of the email I receive. If you have sent me a question, please listen to my podcasts, as I frequently address questions I receive in email during my show.

Please resend your text only email with a description of the contents of the email.

Yea...lots of rules huh? I really do want to hear from you though :)

I have posted twice there with no response the post don't go up unless approved and as you can see there has not been a new post there in five days....what does that tell you.

I've notice people have started post on the connect live issues forum but they are just been pointed to forum 14 and the link to console bans and no recourse.

I'm beginning to think MS has had a serious "brain fart"

During my trawl of the net for my reason for the banning I came across that forum, I thought it said it had links to MS xbox live reps, and some of the answers seemed pretty specific in nature, which lead me to think they did have connection.

In the end I realized they where just muppet's. But ms does have peeps trawling these treads automatically putting people down.

Bull. Microsoft do not have employees trawling Xbox fansites just to pipe people down. That is an unofficial site, the moderators' opinions represent MS as much as anyone here does. Frankly, as mentioned, there's never been a public case where MS have wrongfully banned a console, and like Raze, I'm still expecting it to be something that was done on your console behind your back. Microsoft don't ban consoles without proof, and it's irreversible, so you can be damn well sure that they have solid evidence. I think you took the complete wrong tone with the letter. I doubt Microsoft will give a damn if you're threatening them. Think you should have played that one differently, and I don't see how the media will care about an Xbox ban. Sorry, not trying to be mean, but I just think that the fault was on your end. A console ban is harsh, and not handed down lightly. I'd love to see MS being wrong, but I don't think it'll happen. The Enforcement team do a fantastic job

This could be a complete red herring, but how did your Gamertag motto end up reading "FREE XBOX LIVE"?

I'm sure there's an innocent explanation for this, but it could be read as if you're offering hacks/points etc. This still wouldn't explain why you got a console ban rather than a GT ban so it's probably nothing.

Have you ever had conversations with anyone on xbox live about them giving you points/passwords/account details - have you ever (even in jest) pretended you were a MS employee (or even done anything which might give someone that opinion)

Are you 100% sure that your console isn't modded - you say you bought it new - could anyone have modded it or paid for it to be modded without you knowing?

Has anyone on the console been involved in the modded profiles/marketplace theft? Are there any strange profiles on the machines that now read "profile corrupt" - are there lots of XBLA demos that you haven't used - or have any gamertags in your house got achievements/game histories of XBLA titles that you can't account for?

You haven't a snowballs hope in hell.

Glad to see reason so rife today

Note the "FREE XBOX LIVE" in the motto
