Seperated 3 years - buy new property

    Hi there,

    I'm looking for advice on my current situation:

    I'm seperated (not legally) the last 3 years and will be proceeding with the divorce after the 4th year has passed. There has been no contact between myself and my ex since we split 3 years ago. We did not own a home together and we did not have any children.

    My situation now is that I would like to purchase a family home with my current partner for us and our 1 year old son. We have found the ideal house so would need to move fairly quickly to secure it. My question is, would it be ill advised to proceed with the purchase of a family home before I am divorced?

    You may find that a financial institution will be reluctant to lend on a joint-mortgage basis without some sort of separation agreement in place ?
    They may fear that your ex may otherwise make a claim on the property ?
    Certain amount of conjecture here - you may need to see a Solicitor.
