How can someone drag an appeal against dismissal for so long and still be paid?

  • Registered Users, Registered Users 2 Posts: 20,486 ✭✭✭✭road_high

why is it “hilarious “? Do you get some perverse pleasure in calling someone mentally ill that you don’t even know?
“I don’t like the Burkes so they must be all mentally ill”- get a grip

The best thing for the judge to do now is to start stripping assets and incomes from the rest of family.

This family have been given so many opportunities to purge their contempt of court and they've thrown these conciliatory gestures back in the face of the courts. Enough is enough, the gloves must come off.

It's not their beliefs that people have the major issue with, it's their actions. Look at what they have done in the last few years. You have somebody wandering through a school repeatedly after he has been sacked. He was sacked for behaviour against the principal in a public place. He has been sent to prison multiple times and still goes back to the school when let out. His family have been in fights with court officials, have been roaring at judges, record videos blaming the world for their woes.

    This is not normal behaviour.

No, they deserve to be arrested for contempt of court. Among other things.

He hasn't been arrested or jailed for his religous beliefs.

He could avoid jail very simply by ceasing his contempt of court and carry on for the rest of his life believing whatever he wants.

Read Judge Cregan's judgement and you'll see exactly why he is to be taken into custody. He has lied to the court. He has disrespected the court. He has been abusive to the court. He blatantly ignored court orders. He did all this despite knowing the punishment.

You will also read how he did not pursue legal options in terms of the transgenderism nonsense he protests about, as if he already knew that battle would not be one he could fight.

He is playing to an audience of gullible idiots who accept his (and his families) lies about why he is in trouble. Even better, the judgement is written in plain English so his gullible idiot followers should have no difficulty interpreting exactly what it says about the honesty and integrity of the so-called Christian, Enoch Burke.

From that article - "He did not show up at the school yesterday where there were two security guards posted at the gate."

He is, at least, helping people get work in Ireland.

I'd say he's just waiting to make an appearance at some high profile event so he can make a holy show of himself again. If I was looking for Burke I'd be keeping an eye of the calendars of the taoiseach and president.

Since there is a warrant out for his arrest, at what point does he become a fugitive from justice, if at all?

Statement of assets and income - what if this shows donations from 3rd parties?

Revenue would be interested in this, and he would be liable for 33% CAT gift tax.

If you take the start and present of the Enoch Burke story in isolation, it's very easy to shape it as "he was jailed for not supporting transgenderism". But that's ignoring everything else that happened in-between. He verbally abused his boss at a public event. He was suspended due to this. His dismissal and imprisonment were completely down to his disregard for process and the law, but only when it doesn't suit him.

I agree with you. This narrative that they are crazy and/or mentally ill is a nonsense. It's clear that they are exceptionally religious - to an extent that is not common among Christians in Ireland.

I don't agree with Enoch's behaviour nor do I agree with the religious ideology of this family. But armchair diagnoses of mental illness is not the correct assessment of the situation.

No, I have not heard of one. Then again, I think this is the first time Ireland has had to suffer from an Enoch.

In so far as things have gone, the school sacked him after his behaviour toward the principal and he then appealed his sacking to the tribunal. The tribunal, due to EB's learned way of using its appeals procedures, has been unable to finalise it's dealing of his appeal and certify that he WAS sacked properly in line with the legislation. That is why the Dept is still obliged to issue a teachers paycheque to his bank account.

Thankfully, due to another High Court action, EB has NOT been able to profit financially from the Dept for some time due to the monies being seized by a sheriff and used to pay off his fines.

The only way you can think its transgenderism to blame is if you dont have enough literacy to read literally any article about it and are sucking up all your news exclusively just from the teats of the Burke cult.

Otherwise you know thats transgenderism has been utterly irrelevant to the entire case.

Time to get Tommy Lee Jones on the case - "What I want from each and every one of you is a hard-target search of every gas station, residence, warehouse, farmhouse, henhouse, outhouse and doghouse in that area" 🤣

Tbh maybe he's going on the run to preserve his arse from the rigours of jail…

Why do you think it's nonsense to suggest that there may be some form of mental illness or collective mania at play here as well?

They're exceptionally religious: fair enough, lots of people are. They disagree with the concept of transgenderism - that's not an unknown point of view. And that's not a view, despite what is frequently said, that you can't express on boards.

He feels he was coerced or forced into accepting something that was at odds with his religious beliefs and stopped him from fulfilling his duties as a teacher.

That's his belief. I don't agree with the argument really, but he's entitled to hold it. And there were avenues available to him to appeal and to argue his case about this in a coherent manner.

Okay, he may have still in the end have been dismissed - who knows - but even then he could have used the courts. He could have stood up and argued the actual points of law, articulated his objections coherently.

Who knows in the end how the court might have decided? At the very least I think he might even have gained some sympathy for his point of view.

But, no, Enoch and his family have harraunged and roared and shouted for over three years now. He's spent over 500 days in prison because he refuses to abide by a court order. Some of his family have gone to jail over this.

And what point exactly is he trying to prove by turning up each day? To stay away and to let the appeals process work isn't an admission that you think you are in the wrong?

He's not being jailed or fined because of his religious beliefs - he's being punished because he won't abide by a court order. His behaviour, regardless of his beliefs, is irrational and self defeating. And his family are abetting this: look at the tone and the tenor of their multiple videos.

If you had a colleague at work who was suspended and then dismissed… and they still continued to turn up on the premises every day, despite being told by the courts to stay away, while the appeal process was running - an appeal that that might have a chance of winning in the end - and they ended up going to jail over their refusal to stay away... Would it not make you wonder at all, in the slightest, whether all is right mentally with that person?

Wonder what performative arrest style will Enoch go for when he is finally cornered.

    1. Being led away by a guard on each arm while he rants about his rights.

    2. Handcuffed and led away ranting

    3. Carried away by the arms and legs with the legs elevated in the air.

    Any new ideas?
