Farm inheritance question

    Hi All,

    Looking for a bit of clarity on things as the whole farm transfer process is tricky and details can be confusing. We have finalised the transfer of land from my father to me but father still retains the farmhouse and yard and 40acres surrounding it, as is his right for his own peace of mind. Everything else is transferred.

    The farmhouse and yard are quite valuable, house alone would easily be more than €750k nevermind the yard and land around it.

    I will inherit the house and yard and remaining land upon my father's death, my question is what inheritance tax rate will apply to these, will it all qualify for the 1% ? Or have I a massive tax bill to look forward to?

    (For information, the previous land transfer value totalled 4.5m if that has any bearing on things regarding thresholds etc)

    I know it’s No harm for you to ask on here but Your account and solicitor should have told you all this before the transfer.

    It was covered but no harm to have what i think is the case confirmed by others, the contributions on here may raise other valid questions. Its not a typical situation and im an absentee party in all of this. The retention of the house/yard /40acres would have happened regardless

    Assiming you got agri relief on the 4.5million then you have used your full allowance for inheritance up.


    When you inherit the remainder you should still get relief on it I believe, as long as you meet the required asset test etc. but will be paying 33% of the value (after relief) is my un educated take on it.

    The farmhouse is considered an agricultural asset if on the land. I'm not sure what happens if you already own a house.

    As 893bet says the agricultural relief should still apply so you pay based on 1% value.

    if the remaining land is transfered with house I assume it will be an agri asset. Likely the power for the yard etc is all tied into the house etc.
