Existing Planning Permission

    The planning permission relating to an older house has a condition that states that it is "restricted to use a dwelling by the applicant, the applicants family, Heirs, exec etc, or persons involved in agricultural related activities in the rural area, unless otherwise agreed by the Planning Auth. "

    How can this condition be amended to allow the house to be sold.

    There are no further family members / heirs able to use the house.

    This is something I came across a good few years ago but cant recall exactly what was entailed but from memory I think the client had to apply for planning permission to remove the occupancy clause. Give your local planner a ring and they will advise accordingly.

    Was there a note to say that it was for first 7 years only?

    If in gaeltacth or area of interest?

    I did get a S.47 amended a few years ago, with only talking to the planner and got letter to confirm, which subsequent mortage was drawn down on. Banks were holding off on client until that was resolved.

    It may be possible to remove that condition by contacting the planning office and asking your case, perhaps even doing so by means of another planning application.... But if the perspective purchaser is able to fulfil the last line of the condition ie they get the go ahead from the council that they satisfy the condition, then that's the simplest means out of it.
